It is not a matter of code, but of function. They would be concerned about copyright, because that covers distribution. Patents cover <b>usage of software</b> and in that way it is <b>anybody using a computer</b> who are at risk. Microsoft talking points make use of the misdirection about developers or Free Software or Free Software developers to mislead about the scope of the population at risk and the potential costs.
