schestowitz"great article - I have found new espacenet hard to use and adapt to. My biggest substantove issue- the difference in numbers of docs found for the same keyword search may be explained by simultaeneous search in multiple lagnuages (whichI had no idea was happening)- but I don't think so. Thios was the case even when I limited it to just title and batract via the compelx search. The inabiltiy to re-size docs or remove the drawinsg Aug 16 02:32
schestowitzpage - also a pain, and whilst I would probably get used to the advanced search - it is so diffiult to use for merely simple search, this renders it inaccessible and unusable for most of the general public - whereas most can figure out hopw to put three words - say - int he abtract or title box on classic and know what it means, the default to all text searching is also a pain - and unrecognisbale to a new or inexpert user - Aug 16 02:32
schestowitzwhatever was supposed to be fixed by moving away form Classic has very sadly done away with all the benefits and simplicity abnd elegance of Classic - sorry EPO Team I know you tried hard, I would recommend back to the drawing board. "Aug 16 02:32
schestowitz"Hate the new Espacenet with a vengeance: I find it clunky and unintuitive for some reason. Have kept trying to like it ever since they launched it and I still can’t take to it, so am continuing to use Classic in the hope that it will be improved at some point. I have sent them my feedback."Aug 16 02:32

schestowitzI'm glad I'm not the only one finding the "new" version hard to use. I agree on all your comments about the display. For serious work involving flicking between multiple documents, claims vs description etc, the classic version is a must.Aug 16 02:33

The ability to customise what is viewed in each window would be useful but also the ability to close or minimise one of the windows would be great.Aug 16 02:33

schestowitzThanks for the article. I'm a dilettante user of classic Espacenet and don't like the new one at all. What I think though is irrelevant; the pro users are the ones that matter. And from the comments above, they seem to be even more dissatisfied than me.Aug 16 02:34
schestowitzWhat do we learn from this? What Simon & Garfunkel sang, half a century ago, and what Amazon Chief Bezos grasped decades ago: The over-riding objective is that you've gotta keep your customer satisfied. Perhaps the EPO doesn't need to with quite the same urgency as a company with its competitors breathing down its neck but that's an advantage. The EPO can take the time it needs, to make New Espace better than it is currently.Aug 16 02:34
schestowitzCome on EPO. It's not too late, to solicit feedback, think about it, and then act diligently upon it. From the comments above, you enjoy quite an accumulation of goodwill from your pro customers. Don't squander it, please.Aug 16 02:34

schestowitzAs long as the old Espacenet will be available I will not use the new one. I can only agree with the comments above. Aug 16 02:34
schestowitzWhat is still a pain is the way you have to input the number of a document, lets say you want to consult as it has been cited in a TBA decision. Instead of WO 2007/123456 you need to delete the / in the middle. You cannot input the number as you find it. EP 2 222 222 has to be input EP2222222. Japanese documents are difficult to retrieve, be it with the new or the old Espacenet. This will not change for a while as I have been told Aug 16 02:34
schestowitzby a member of the Espacenet team during the break of a conference held on the EPO premisses. Aug 16 02:34
schestowitzI do agree, the new Espacenet is a nice try but the EPO could do better. However the self glorification forces of the EPO have struck again.Aug 16 02:34

schestowitzOld espace is not without its problems. As I noted in a letter published in the May 2020 CIPA journal, while the UKIPO had provided the EPO with an essentially complete PDF collection of its patents, it seems that the EPO has replaced some of them with just the far from error-free machine-recognised text of the abridgement, description, and claims. For the drawings you are referred to those of allegedly-equivalent patents, which in Aug 16 02:34
schestowitzthe case of the one I wanted, were far from being equivalent. The document in question was GB585791 (not GB595971 that I dyslexically wrote in the CIPA letter. Aug 16 02:34
schestowitzAt least old espace did find it: on checking just now, new improved espace says it does not exist! Aug 16 02:34
schestowitzAdmittedly my experience is based on a single document, but it seems highly unlikely that mine would happen to be the only one of the many hundreds of thousands of GB patents that has been treated in this way.Aug 16 02:34
schestowitzPersonally I shall continue using the excellent German Patent Office's DEPATISNET. It has an english-language interface for non-german speakers, with basic and expert mode interfaces, the latter providing user-customisable presentations of search resultsAug 16 02:34

schestowitzAn update: new espace does in fact find GB 585791, but still with the same limited information. The problem was that, as noted by Attentive Observer, new espace is very picky about how you enter the number. Old espace happily finds GB585971 (no space after "GB"). New espace needs a space between "GB" and "585971".Aug 16 02:34

-TechrightsBN/#boycottnovell-ipkitten.blogspot.com | Shining the light on insufficiency (T 1285/15) - The IPKatAug 16 02:35
schestowitz"Aug 16 02:35
schestowitzThere remains a problem with the statement under point 12.2.7 of the reasons relating to trade marks. The BA held that “The fact that the disclosed embodiments are identified by their trade names rather than by their chemical formula is not decisive. The skilled person would have been capable of obtaining information on the respective chemical formulas if need be”. The problem is that the composition sold under a given trademarkAug 16 02:35
schestowitzmay change over time or might even disappear from the market. What then?Aug 16 02:35
schestowitzI know that very often this problem is dealt with under Art 84, but I would rather consider it a problem of sufficiency. Nothing against explaining that some products are commercially available under a trademark. What is determining is the bulk chemical component underlying the product sold under a trademark, not the trademark under which they are sold. When Teflon® is used, is it the PTFE forming the bulk of Teflon® which allows Aug 16 02:35
schestowitza given effect to be obtained or one of the additives added to the PTFE sold under Teflon®.Aug 16 02:35
schestowitzA majority of decisions of the BA are considering that Art 84 is at stake there and not Art 83. I am not convinced that it is the right approach in all cases. Aug 16 02:35
schestowitzIn T 0987/16, vermiculite was sold under a trademark, hence sufficiency can be agreed upon. In T 842/14, the anti-foam agents essential to the invention were only defined by trademarks, and sufficiency was denied. T 842/14 is also interesting in that in points 23-25 of the reasons some review of case law in the matter of Art 83/84. Aug 16 02:35
schestowitzWhile it is possible to go from the chemical composition to the trademark, the reverse way is not possible as it implies adding matter to the original disclosure. Aug 16 02:35
schestowitzA prima facie way to discriminate between Art 84 and Art 83 is that the former might be corrected provided there is a proper disclosure, whilst lack of sufficiency can in general only be overcome by adding subject-matter. Aug 16 02:35
schestowitzThe present decision is also interesting as it made clear that submissions from third-parties filed after expiry of the opposition period are to be treated, by way of a legal fiction, as "late". Article 115 EPC cannot be used to extend third parties' rights, let alone extend them beyond the rights of parties to the proceedings. As the documents were filed again in appeal by one of the parties, they were considered highly relevant Aug 16 02:35
schestowitzand admitted. Aug 16 02:35

schestowitzKantWednesday, 12 August 2020 at 12:59:00 BSTAug 16 02:37
schestowitzAttentive, the problem is that enablement is required at the filing date, not some time after publication. If is to be assumed that the trade marked product is commercially available at the filing date, there is no enablement issue present. A clarity objection is the correct one.Aug 16 02:37
schestowitzReplyAug 16 02:37
schestowitzAttentive ObserverWednesday, 12 August 2020 at 20:43:00 BSTAug 16 02:37
schestowitzDear Kant,Aug 16 02:37
schestowitzI beg to disagree. The problem is similar to that of norms. A norm can vary between the priority and the filing date. Which one is then the norm applicable? A norm can also vary with time like the composition of a product only defined under a trademark. Just giving the number of a norm is not enough, the valid date/version of the norm has to be given either at filing or at priority date. Adding the date after filing amounts clearly Aug 16 02:37
schestowitzto add subject-matter, hence there is a problem under Art 83 and not Art 84. Aug 16 02:37
schestowitzThe same applies if the determination of some features is disclosed as being carried out on a specific machine. This machine has to be available during the whole life time of the patent. Aug 16 02:37
schestowitzIn point 3.3 of the reasons in T 1714/15 the BA held that an invention has to be enabled throughout the lifetime of a patent. As the machine needed to measure a given parameter is no longer available then sufficiency is lacking. Aug 16 02:37
schestowitzIn Point 3.3.2 of the reasons the BA added: “Confirmation of the fact that a patent has to be enabled throughout its whole lifetime, especially when the feature under consideration is a product which is marketed under a trademark, may be found in Case Law of the Boards of Appeal of the EPO, 9th edition 2019, Chapter II.C.6.6.9, third paragraph: "[When] the products designated by trademarks are essential for carrying out the Aug 16 02:37
schestowitzinvention, the requirements of Art. 83 EPC are fulfilled if these products are available to the skilled person not only at the priority and filing dates of the patent but also during its whole lifetime".Aug 16 02:37
schestowitzThat in certain jurisdictions it might be enough when the product only defined by a trademark is available at filing time, in view of the above the only valid conclusion at the EPO is that the correct objection is Art 83 and not Art 84. Aug 16 02:37
schestowitzWhen coming up with Art 84, the BA make life easy for them as in opposition it cannot be brought forward. But this is not always correct.Aug 16 02:37

schestowitzIn my opinion, neither the decision T 1714/15 nor the cited passage of the Case Law of the BoA find any basis in the EPC and are thus not to be followed. If the patent applicant sufficiently disclosed the invention the priority/filing day, the public benefited from the disclosure. Hence, the patent applicant deserves patent protection as compensation.Aug 16 02:37

schestowitzAny opinion has to be respected, but it fear you might end up in the wall with your attitude, at least at the EPO. Aug 16 02:37
schestowitzThe patentable contribution to the art does not stop one day after filing, but the availability of the technical teaching should be insured over the whole lifespan of the patent. Aug 16 02:37
