As long as the scope of the claims are clear (as required

From a practical standpoint, most patents are shelved. The few that are asserted are likely to have sufficient value that the parties (either on their own or through the courts) can spend the time and money to litigate what the patent covers and what it doesn't. This acknowledges that the

In the U.S., the USPTO (for better or for worse) has adopted the

That's something we want to change, adding more funding sources, including individuals and grants from different sorts of institutions. It will not happen overnight though, it'll take time.
