schestowitzProbably shutting the stable door after the horse has bolted, but I have only just checked IPKAT and noticed its quoting of my post from last year.Feb 18 15:01
schestowitzPerhaps I might add some further observations. Between leaving industry, where I had worked on the design and development of advanced military radio systems, and joining the patent department of what was then a major electrical company, I spent some 13 years as a Patent Examiner/Senior Patent Examiner with the UK Patent Office. My initial training was in the last years of the PA 1949, where examiners were required to carry out a muchFeb 18 15:01
schestowitzmore thorough examination than the recommended practice under the PA 1977. The entire description had to be meticulously read, marking (in pencil) on the copy that was then returned to the applicant, any unclear or contradictory matter.Feb 18 15:01
schestowitzWhere it was apparent that the applicant (or his agent!) hadn't quite got to grips with the invention, examiners were expected to draft a set of claims that would make the invention novel (the statute did not allow examiners to raise inventive step objections). So I had plenty of experience in amending claims to avoid prior art while ensuring that the claims were fairly based on the description.Feb 18 15:01
schestowitzAs part of my training I was an active participant in an Inter Partes revocation action hearing before the Comptroller, sitting as a member of the three-man panel at the hearing, in which both novelty and inventive step were issues. I subsequently attended the High Court appeal as an observer in the public gallery, and wrote a detailed summary of the proceedings for the Assistant Comptroller in advance of the official court transcript.Feb 18 15:01
schestowitzWhat I found particularly interesting was that the judge decided the matter on the construction he put on a particular expression. The meaning of that expression had not been an issue with the parties or the Patent Office, who all agreed that it meant A. However, the judge decided that it actually meant B! An object lesson that, however carefully you analyse and construe, litigation can be a bit of a lottery.Feb 18 15:01
schestowitzI have now had a look at the "Gantrygate" paper, and was amused to note that the breaking-down of claims into numbered sub-sections, something that in my day the examiners' comments said was calculated to annoy them, is now recommended practice! Confirmation, if any were needed, that fashions do change and that you need to find out what the examiners want and give it to them, rather than adopting the procedures that, in my experience,Feb 18 15:01
