I think the concept of purchase verification in digital stores is a great one. Really. But. The implementation of the said idea can sometimes be rather crude. Lo and behold, my latest experience wtih the Google Play store. I presume the application received an update, and when I launched it, instead of getting into the main interface, Google Play popped a full home screen banner, telling me I've n [11:27] schestowitz[TR2] ot set any purchase verification.

The purpose of Art. 71c.2 is preventing parallel proceedings (and potentially irreconcilable decisions) involving the same parties and the same patent. It is clear that, for UPCA Member States, Art. 71 [18:25] schestowitz[TR2] c.2 is supposed to do the same job as Art. 71c.1 does for states that are not party to the UPCA.

Art. 71c.1 clearly applies the lis pendens rules of Brussels II regardless of when the parallel (national and UPC) cases were filed. So why should Art. 71c.2 be interpreted to apply to fewer national proceedings in UPCA Member States (i.e. be limited only to national proceedings initiated during the trans [18:25] schestowitz[TR2] itional period)? That makes absolutely no sense. Indeed, that interpretation greatly increases the risks of the national courts and the UPC reaching irreconcilable decisions, including in respect of the same UPC Member State.

The interpretation applied by the Paris Central Division is even more difficult to understand in the light of the fact that it means that the UPC is:
    - ignoring prior proceedings commenced be [18:25] schestowitz[TR2] tween the same parties in Germany; and
    - thereby risking the issuance of irreconcilable decisions in respect of a patent monopoly that is only valid in ... yes, you guessed it, Germany!

It seems to me that the CJEU's input will be required to put the UPC straight on how to interpret recast Brussels II." Both the EPO and U [18:26] schestowitz[TR2] K tests for interpreting Art 52(2) lost touch with any sensible legislative intent long ago." ● Aug 22 [19:56] *psydruid (~psydruid@jevhxkzmtrbww.irc) has left #techbytes ● Aug 22 [20:19] *psydruid (~psydruid@jevhxkzmtrbww.irc) has joined #techbytes [20:25] schestowitz[TR2] " [20:25] schestowitz[TR2] Of course it's true. [20:25] schestowitz[TR2] " [20:25] schestowitz[TR2] " [20:25] schestowitz[TR2] To be clear, DEI isnt the problem here. It's completely beside the point. It's a convenient oversimplification and a knee-jerk rightwing talking point that falls right into a trap. Alvind and the Pipmunks are exploiting DEI to hire their own kind to the exclusion of everybody else, including women and other minorities. They are equal opportunity bigots. Everyone BUT Alvinds preferred kind is being RAd and pipped into obliv [20:25] schestowitz[TR2] ion. Women and minorities are not the enemy. They are victims of AK as well. [20:25] schestowitz[TR2] He hires an overwhelmingly disproportionate of people from his country of origin and then says that he has exceeded some arbitrary DEI quota he imposed on himself ergo no one else is protected. He declares he has cleared some bar he set for himself which gives him license to start firing people with impunity because of his DEI bonafides. It doesnt even make sense. [20:25] schestowitz[TR2] I think there is another explanation. The man is the product of a caste system that he is perpetuating using DEI as a smokescreen. If you look at many American board rooms these days you will see that it has become the province of privileged, Indian-born men of a certain vintage who have been taught that they are better than everyone else. Maybe they think they finally turned the tables on their white counterparts. And perhaps they [20:25] schestowitz[TR2] have. They certainly have a lot in common with them. [20:25] schestowitz[TR2] They have been raised and educated as princes in what essentially amounts to a form of social, cultural, and religious apartheid, to say nothing of the backdrop of extreme s-xual violence and misogyny against women. You can only imagine the sociopathy that comes out of that kind of system. Half of these guys ended up at McKinsey when they came to this country, and the other half rose into leadership positions at other companies and [20:25] schestowitz[TR2] then hired their buddies at McKinsey to come and pillage and purge. [20:25] schestowitz[TR2] Alvind is just another in a long line of disreputable, greedy, self-serving Indian mafioso, including Rajat Gupta of McKinsey, who was convicted of insider training, and went to prison; Anshu Jain of Deutsche Bank, who encouraged the bank to acquire Donald Trump as a whale of a client and turned the company into a money laundering operation; and Vikram Pandit of Citigroup, whose leadership required a $45 billion bailout and w [20:25] schestowitz[TR2] as forced to resign, just to name a few. [20:25] schestowitz[TR2] You can blame a lot of things for what is happening at IBM, but DEI is not one of them, and Alvind is no friend of DEI. [20:25] schestowitz[TR2] I have no problem with anyone of any race, nationality, or gender in a leadership position if they are good leaders. But these people do not deserve our respect and I think they are wearing out their welcome. Alvinds day will come too, and not a moment too soon. For example, executives like to think that Indians who went to Harvard, Oxford or Cambridge will act like native British or Americans. It's more likely that Indian executives will retain their native culture, and native British or American leaders will do as m [20:57] schestowitz[TR2] uch as they can to accommodate the Indians.
