Madison in 1803, which is 5 years newer than the Alien Enemies Act of 1798.
[22:24]	IsambardPrince	The Supreme Court decision in Ex parte Milligan held that US citizens cannot be made to stand trial in a military tribunal unless the civilian courts are not functional, and Habeas Corpus Act of 1867 guarantees American citizens the right to due process of law, which together would seem to suggest that the Alien Enemies Act is at least partially unconstitutional, as it applies to American citizens.
[22:24]	IsambardPrince	But we are not living in normal times. According to NPR, Trump apparently defied a court order pausing his use of the Alien Enemies Act, and deported 300 people to Ecuador, which he was ordered to not deport pending further order of the court.

[22:25]	IsambardPrince	I added: "The Immigration and Nationality Act also sets up Immigration Courts, and says that green card holders (Lawful Permanent Residents) have the right to appeal deportations into the regular federal courts, which would appear to mean that they have a right to object to deportations under the Alien Enemies Act of 1798, even though they're not US citizens."
