The Democrats repealed the "trap law" a couple years before the Dobbs decision reversed Roe. [06:36] DaemonFC In the case of same-sex marriage, the federal law called DOMA made it impossible for the federal government to recognize it and said that States didn't have to recognize it if you got married somewhere it was legal. [06:37] DaemonFC When the Supreme Court struck down DOMA, it did it with the same legal reasoning used to strike down abortion laws, used in Roe. The reason that doesn't matter is because DOMA was legislatively repealed by Congress and replaced with the Respect for Marriage Act. [06:37] DaemonFC So the law that was struck down, DOMA, does not exist anymore, and cannot be litigated. [06:38] DaemonFC The new law says the feds will recognize the marriage if it's legal where it was performed, and between two adults. [06:39] DaemonFC It also says that States have to recognize it if it is valid under RFMA.
