China's Oceans of Fake Patents on Buzzwords and Hype Reinforce the Widespread Belief That Some Patent Systems Go Astray
The Register (UK) has a new article about so-called "Generative Artificial Intelligence" ("GAI") patents. The headline says that "China filed most Gen AI patents since 2013" (we saw the same in other sites), but those are just software patents and merely filing or even getting (securing) many patents says nothing about their merit. To quote: [via "Chinese Gen AI Researchers Snagged More Patents Than Everyone Else Combined Since 2013"]
The Org's Patent Landscape Report – Generative Artificial Intelligence, delivered on Wednesday, found 733 patent families – sets of patents related to a single invention and with the same technical content – on GenAI in 2014 ballooning to more than 14,000 in 2023.
Scientific papers on the topic also exploded – from 116 in 2014 to more than 34,000 in 2023. A quarter of all GenAI patents, and over 45 percent of all GenAI scientific papers, were published in 2023 alone.
So what? They're conflating patents, which are immaterial, with something else, possibly to reinvigorate the old "GAI" hype bubble. That China games the system (at WIPO) by granting loads of junk patents is hardly news because even the "Establishment" media kept saying this almost half a decade ago and we said something to that effect several times even years earlier. China's strategy is to just fling lots of crappy patent fodder at the wall, hoping to outnumber or drown out whatever comes from "IP5". If anything, this serves to discredit the system or legitimise patents. If this system falls under its own weight, China won't care; maybe that's an actual objective.
"The Register has an article about software patents," an associate said, and "China ignores the software patents but by filing tons of them they will be able to paralyze the West which is under the control of the WIPO. tldr; software patents do not affect China and harm the West."
Yes, it has been heading in this direction since before SIPA became CNIPA. They and the corrupt EPO are cheating to fake "production" or "innovation", but at whose expense? Who's gonna pay for this utter chaos? █
