In a flurry of recent decisions, the Supreme Court has continued its skepticism of administrative agencies. Although these decisions may not have as significant an impact in patent monopoly law as in other areas, they do pose interesting puzzles with respect to stare decisis as well as agency rulemaking and discretion that will provide many litigation opportunities going forward.
Consider first stare decisis and the Court’s overruling of Chevron deference (i.e. deference to reasonable agency interpretations of ambiguous statutes) in Loper Bright Enterprises v. Raimondo. While the Loper Bright Court said that principles of “statutory stare decisis” meant its decision did not “call into question” holdings of cases that applied Chevron to find “specific agency actions” lawful, the Court did not discuss in any detail what “specific agency action” means.
Notably, the 2016 patent monopoly law case of Cuozzo v. Lee was the last case in which the Court itself found an agency action reasonable, and therefore lawful, under Chevron.

JUVE ☛ “UPC pulls ripcord on CMS in time, but proximity to the EPO is questionable” [Ed: UPC is illegal and unconstitutional. It must be shut down, but this publisher basically took bribes to promote this crime, in effect helping EPO corruption as well.]
The announcement came as a surprise, but it came at the right time. Last Friday, the Unified Patent Court announced that it was ditching the old CMS and introducing a new one. This new system would be a joint project with the EPO, implemented by mid-2025.

On 16 July 2024, the Munich Central Division revoked a patent monopoly for the first time in the litigation between Sanofi, Regeneron, and Amgen (UPC_CFI_1/2023). This decision is important not only because it is the first of its kind, but also because it establishes UPC’s position on the patentability of therapeutic antibody inventions.
