Microsoft Has a Long and Proven History of Funding Meritless Lawsuits Against Rivals and Critics (It Always Backfires)

posted by Roy Schestowitz on May 12, 2025

"On the same day that CA blasted SCO, Open Source evangelist Eric Raymond revealed a leaked email from SCO's strategic consultant Mike Anderer to their management. The email details how, surprise surprise, Microsoft has arranged virtually all of SCO's financing, hiding behind intermediaries like Baystar Capital."

-Bruce Perens in "Commentary: SCO's Tapestry of Lies", Linux.com article has since then been taken down by the Linux Foundation's neglect or incompetence, so its biggest sponsor (Microsoft [1, 2]) might be pleased

Repetition is quite dull for those having to write about things over and over again (sparing oneself the repetition can be done by linking to past writings), but over the years Microsoft tried about 10 times to silence me, usually by contacting employers of mine, issuing threats, bribing people connected to me, and now we have actual Microsoft staff funding SLAPPs against me (the law firm repeatedly refused to deny this and now it's under investigation by British authorities).

"I guess there is also a tangent about Microsoft and its financing of the SCO lawsuit," an associate said to me this morning, "thus causing PJ to found Groklaw, but that is another topic especially now that most of the Grolaw pages are missing from the old site..."

Many articles about the SCO case are now gone, leaving room for revisionism despite the death of SCO's Darl McBride.

It also looks like the solicitor used by two Microsofters to SLAPP us (yes, my wife also) is being urgently replaced: (he got sacked or resigned [1, 2, 3] with an impending "last day" assuming notice has been handed in amid financial and regulatory issues)

Senior Associate: Media and Communications Law (5+ PQE)

Who's next? "Junior"? The Barrister who stupidly chose to associate 5RB with actual stranglers of women because there was Microsoft money "on tap"? This whole censorship expedition by Americans truly went the wrong way (even backfiring [1, 2]) the moment Microsoft money landed on their laps, implicating many others including the OSI, as we'll show (again) later today.

We'll need to put an end to all SLAPPs and work towards compensation for victims of SLAPPs.

In hindsight, on top of the fact this go-to SLAPP firm no longer has any media lawsuits this year (none!), one can see them doing more SLAPPing around the same time they targeted us and TaxPolicy [1, 2, 3], e.g. starting a case, never serving actual claims, and without any lawyers involved they just drop it all - likely a form of extortion, e.g.

Kastrup v Murphy: No claims, No lawyers, Intimidation tactics using dockets

This was two weeks after their first SLAPP against us, repeatedly trying to "settle" over a meritless issue (since February 2024 when they started flinging phonebook-sized paper parcels at us); Two Judges ("Masters") have since ruled in our favour, independently.

It won't be over until the Microsofters pay for what they did. Their facilitators too must pay, they cannot just run away like Jim Zemlin's wife ran away after likely orchestrating (as CRO) Securities Fraud at Bakkt. People must pay for their bad deeds; bullying people who write about their bad deeds is a threat to functional societies and must never be tolerated.
