This typical play by Microsoft appears to be to muddy things so that they enlist the support of many others by having it appear their fates are intertwined.. so that they appear to be one of the gang. After all, many don’t want patents to be abolished for costly “hard” items; thus (would go the argument), they have to support the “soft” as well.
