The rules on patents, as they are today, don’t support the court’s position. The court is defacto lobbying for M$ by acting as if both the Unitary Patent were actual and that it validates software patents.

Software patents are not valid in Europe at all as per the 1972 European Patent Convention. The court should have thrown it out and fined M$ for wasting the court’s time. It doesn’t make sense that the court should ignore the treaty at the behest of M$.
