SCOTUS and CAFC help cushion them in the US (I believe the latter put them in place decade ago) and we know the effect of lobbying on both. You can’t separate courts from patent offices and corporations; they’re incestuous by nature.

Yes, the Unitary Patent is a huge threat but that threat is not yet realized. The rules on patents, as they are today, don’t support the court’s position. The court is defacto lobbying for M$ by acting as if both the Unitary Patent were actual and that it validates software patents.

With the Unitary Patent, the EPO may soon seize control of patent law and practice in Europe (no oversight). No wonder Microsoft and its lobbyists push hard for the Unitary Patent.

Why is this case even being argued? Software patents are not valid in Europe at all as per the 1972 European Patent Convention. The court should have thrown it out and fined M$ for wasting the court's time. It doesn't make sense that the court should ignore the treaty at the behest of M$.
