schestowitzRed Hat never did fulfill the GNU spirit. It always worked closely together with corporations. This does have both pros and cons, mostly cons though. But I remember a Red Hat person being on the Linux Action Show of Jupiter Broadcasting several years ago. They mentioned that a lot of open source code was actually negotiated by corporate interests. For instance, the fact that we could use CD-ROM devices back in the 90s was due to Red Hat andMar 04 06:10
schestowitzsimilar interest groups negotiating deals for more free licenses with big corporations which control such technologies. A lot of the stuff wouldn’t be available had Linux (as in the kernel) been a purely free software endeavour. That’s a sad truth of a corporate-driven tech infrastructure. That being said, a Red Hat is still a lot more benevolent than Google. Maybe becaucse it’s still too small? Maybe because it’s trully more ethical?Mar 04 06:10
schestowitzWho knows.Mar 04 06:10
schestowitzDebian walks a fine line. It is trully committed to free software, but it’s also in this open source world in that it does work together with certain individuals who work for corporations or smaller companies like Canonical. Debconfs are also in part financially supported by corporations, because at the end, Debian makes for really rock solid servers. But on desktops, I’m most comfortable with Debian. OTOH, it also offers non-free andMar 04 06:10

schestowitzSo if RedHat were to make free software to be run on voting machines, this would be against the GNU spirit? Would you prefer if the military used proprietary software made in another country?Mar 04 06:10
schestowitzI don’t see any problem in companies making money with free software. And we can’t forget that, in the end, business is business. If RedHat doesn’t work with the government, somebody else will.Mar 04 06:10
schestowitz"The govt. does much more than making voting machines. Depending what country you live in, the govt could be, for instance, using free software to engage in illegal espionage or wars. Using “govt.” as a monolithic term with one set of interests doesn’t work for this discussion. Of course, setting up desktop computers for a primary school or workstations for a missile command station are two completely different ethical questions.Mar 04 06:10
schestowitz"Mar 04 06:11
schestowitzAnd I don’t think the free-software movement cares or should care about these issues. It is solely about the user having control over that software that runs on their machine. What runs on somebody else’s machine is none my business.Mar 04 06:11

schestowitzFighting multiple issues simultaneously is a great way of having everyone disagree.Mar 04 06:12
schestowitzNot everyone, some people would disagree. I know a lot of people who’d agree with me. And again, there’s no need for anyone to use my software, they can just take something else/rewrite something from scratch. Also, GPL is not the only free license. I can make an anti-commercial and pacifist free license. Free software is more than just the GPL, and the GPL was also mostly modelled after American ideals of freedom and is not necessarilyMar 04 06:12

schestowitzI think that would make it cease to be free software according to the FSF.Mar 04 06:12
schestowitzI have to amend your argument in that the GPL and FSF don’t technically advocate for absolutely free software, since absolute freedom would also entail that you’re free to make a fork of the software and make it proprietary. Another often implied restriction of groups such as the FSF is the restriction of freedom to, for example, spy on people. So, certain free software made by Google would never be considered free software by the FSF,Mar 04 06:12
schestowitzthey’d call it open source maybe. My point is that none of those free software concepts are free of ideology, as is nothing else in society. Since the FSF and GPL come from an American cultural context, issues like pacifism might not be part of the license, but things like fighting surveillence are, even though they’re not directly the concern of code freedom.Mar 04 06:12

schestowitz    I also noticed some oddities in the figures. They seem low in the 2008-2011 time period, compared to my recollection of that time. I mentioned after your last post that I had asked Darts whether they had included the IPCom cases.Mar 04 23:43
schestowitz    Their response has since come through. They said: "The Mannheim IPCom v. Nokia 2007 actions are part of the numbers presented in Figure 1 (Evolution of NPE related litigation), although those actions are not reflected in Table 1 (List of most assertive NPEs)"Mar 04 23:43
schestowitz    There were 8 IPCom actions filed in Mannheim 2007. But there were many more filed after 2007, including in Mannheim and in Dusseldorf, as well as cases in Milan, Vicenza and Macerata. In one case filed in Bologna, IPCom asserted over 50 Italian patents. There were fifteen or so patents litigated in the UK (although not all had infringement claims).Mar 04 23:43
schestowitz    So it seems that Darts has not picked up any of these. That may explain why the numbers in the earlier time period seem low.Mar 04 23:43
schestowitz    That's quite understandable. It is difficult now to go back in time and find old cases filed in many of those courts. I am wondering, therefore, whether the data merely shows that Darts is better at recording recent cases than older cases. It may be that the 19% year on year rise in NPE litigation that some commentators take from the report is simply a 19% year on year rise in completeness of the data.Mar 04 23:43

schestowitzLong term once the network launches it’ll pay for itself. If you want to upload to the network you need to pay in safecoin. To get safecoin you need to devote resources to the network via farming. The network will adjust the farming rate (the amount of safecoin awarded to farmers for the resources they provide) based on the amount of resources needed by the network. So if there is a lot of stuff being uploaded but not enough farmers moreMar 06 07:50
schestowitzsafecoin will be given out to farmers. If there’s a lot of resources available but not a lot of resources being used then it’s only a little bit. When you farm it’ not a direct payment, more like a lottery. Devs get automatically paid by the network based on the amount their software is used. So it’s in their best interest to develop useful software that gets downloaded a lot. Same with content creators.Mar 06 07:50

schestowitz    I would like to reply to Darren's post, but unfortunately it cannot be anonymous. Troll! No. Employed? Yes. Obviously certain people cannot comment and for others it is unwise even if in no way involved. I speak as one having no knowledge of the Pfizer actions.Mar 06 20:38
schestowitz    The priority issue is certainly plausible as a validity argument, but I think even Darren would agree it would fail as an attack. There is specific case law directly on the issue of enantiomer novelty with the same facts. In any case, this potential invalidity would not have stopped any right-thinking attorney from filing an SPC.Mar 06 20:38
schestowitz    I agree also about the potential for a competition commission attack for obtaining an SPC on a knowingly-potentially-invalid patent, however, again, this would not be sufficient to warrant abandonment. The Italian decision on abuse is utterly ridiculous and Pfizer would not err in acting to protect their interests even in the face of such challenges.Mar 06 20:38
schestowitz    At no time could Pfizer have been considered to enforcing knowingly invalid rights because the priority argument is too weak.Mar 06 20:38
schestowitz    So, why abandon the SPC? As Darren noted, the applicant is Northwestern University. The applicant in the later-expiring neuropathic pain use case is Warner Lambert (Pfizer). If we assume there was no validity or competition law concerns, the answer must either be a simple commercial decision or a mistake. On both counts, Pfizer may wish not comment.Mar 06 20:38
schestowitz    An SPC on the compound patent would have resulted in the extension of royalty payments to Northwestern. However, market protection was available without royalties by virtue of the use patent. The SPC would have expired May 2018, 10 months post-expiry of the use patent. Is it possible there was more profit for Pfizer in abandoning the SPC?Mar 06 20:38
schestowitz    I am surprised the licence with Northwestern didn't require the SPC filing, but it is also possible a deal was reached. After all, the pain market was an unexpected bonus.Mar 06 20:38
schestowitz    Another question relates to the lack of filing of an SPC on the use patent instead.Mar 06 20:38
schestowitz    It is all very murky. Darren, I suggest you make a formal request of Pfizer for information.Mar 06 20:38

schestowitz"Mar 06 20:38
schestowitz    Thanks for your comments, Anon. I am sorry that my personal blog is not suitable for anonymous comments, and I do appreciate the issue.Mar 06 20:38
schestowitz    I agree that there is "specific case law directly on the issue of enantiomer novelty", but the cases I am thinking of (eg escitalopram) do not seem to me to have the "same facts". What case are you thinking of?Mar 06 20:38
schestowitz    I am also not clear how the use patent could have formed the basis for an SPC since the first marketing authorisation was not in respect of pain, so at the time of the issuance of the first marketing authorisation, the use patent did not protect the product.Mar 06 20:38
schestowitz    Your comments on ownership are very interesting and I shall ponder them. I cannot believe that it was a "mistake" as it is actually quite hard to abandon an SPC in multiple countries simultaneously.Mar 06 20:39

Over the last 17 years, we've seen the rise of patent trolls that exploit the vagueness of patents and the high costs of litigation to extort money out of victims who simply can't afford to vindicate their rights in court.
