In the case of the Linux kernel that would be GPLv2. So if Satya Nadella and his crew at Microsoft wish to build Azure Sphere OS around GNU and Linux I wish them all the best. There choice is an amazing endorsement of Free Software and GNU/Linux ecosystem in particular.Jun 17 05:08
schestowitzYears ago Microsoft shipped a variant of Unix they called Xenix. Given that DOS, real-mode Windows, OS/2 and Windows NT are all different operating systems, it is not as if Microsoft hasn’t been involved in different OSes.Jun 17 05:08
schestowitzDevelopments like this also highlight the difference between BSD vs GPL license. Both Windows and macOS have components based on BSD, but not much gets shared back to the community. In contrast Linux under GPL results in more share-and-share-alike.Jun 17 05:08

Microsoft did develop a couple OSes for small devices – Windows CE and Windows Phone. I suspect Nadella and others at Microsoft do not believe device manufactures would be willing to pick these OSes for their products. It is also true the Mono project has been successful in brining C# and .NET to GNU/Linux. Since MicrosoftJun 17 05:09
schestowitzacquired Xamarin (developers of Mono) in 2016 it would seem they see a future for GNU/Linux and have decided on a join-em rather than beat-em strategy. Maybe we’ll see Microsoft one day buy Codeweavers (developers of Wine) and/or whoever is the main sponsor for ReactOS ;-)."Jun 17 05:09

Some bad programmers created a machine learning algorithm that flagged her behavior – she had hit the backspace button too many times. Turns out the price scanner had been broken, and so my mom was manually entering prices. Unlike at the ATM where to specify $25.00 you type 2500, the computer at Williams Sonoma requires you to type 25.00. So she hit the backspaceJun 17 05:48

schestowitzIf we have a UBI and/or jobs guarantee we can have the discussion about what jobs we want to have and what jobs we don’t want to have. And working class* people should be leading that discussion! I can’t tell people to adopt my upper-middle-class values** and demand a UBI. schestowitzUpward redistribution of wealth tends to reduce aggregate demand as poorer people have a higher marginal propensity to consume. Automation can in theory increase the wages of lower income people if you assume that people earn their marginal product (i.e., employers add employees till the marginal revenue product of the last employee equals the marginal factor cost, and each employee earns a different wage depending on the order in which sheJun 17 05:52
schestowitzwas hired and based on what she does). Since a single worker can produce more widgets if she’s working with automated production processes, she will earn her higher marginal product. Obviously, this is decidedly untrue. Efficiency wages and principal-agent problems about in labor markets. Plus, product markets are not so competitive. Monopolies tend to undersupply and overcharge for goods and services and they’re often not suddenly goingJun 17 05:52
schestowitzto choose to produce way more if production processes improve. Similarly, your local market won’t sell way more goods in part due to monopoly power (to get people to buy more cans of beans you’ll need to charge less) but in part because there’s a finite supply of groceries people living nearby will buy. You’re not dumping corn into a sea of corn; you have price-setting power and there’s a limit to what you can sell.Jun 17 05:52
schestowitzSmashing the machines would in fact aggregate demand because more people will earn wages and will then buy things in stores. This aggregate demand boost will actually increase the marginal product of workers in these robot-less stores because, say, in a supermarket that has competition you staff to meet peak flow but if aggregate demand is high you might sell way more product while only employing a few more people as cashiers are activelyJun 17 05:52
schestowitzchecking people out their whole shift not twiddling thumbs for half of it. As all of you probably recall, the Linux Foundation is a group of companies that commercially support Linux and similar Open Source software. This is a group of companies acting for their collective interest and not necessarily for the best interest of the community.Jun 19 06:28
schestowitzAs you can see in this page, this white paper was written to promote on of the LF’s projects, Open Network Automation Platform. I haven’t heard about this project before, but a look at its steering committee shows that it is composed of members of 20 companies, including Amdocs. So Roy found a page where Amdocs uses this white paper to promote whatever it is they want to promote (maybe even this project) and thus they put their name on it.Jun 19 06:28

Earlier this year parent company HMD made the bold decision to switch to Android One for its entire family of phones, from the budget-minded Nokia 3.1 to the Snapdragon 835-powered Nokia 8 Sirocco. That means when you buy a Nokia phone you’re getting the peace of mind that you’ll get updates, and timely ones at that, for at least two years, and security patches for three years. </Jun 20 03:46

schestowitz"Thank you. Now you all know which kind of people ruled the epo during the last 8 years."Jun 22 00:46
schestowitz"Jun 22 00:46
schestowitzBravo, Thorsten! It is important that these facts are brought into the light.Jun 22 00:46
schestowitzThe facts themselves are pretty explosive in the context of how the Corcoran matter was handled within the EPO. However, they also raise numerous, new questions. For example, there are questions relating to why and how the private litigation was pursued:Jun 22 00:46
schestowitzFirstly, it is inconceivable that the legal advisors of the private plaintiffs were unaware of the procedural requirements for pursuing the case. Does this mean that the decision to pursue the case filed in 2016 was made purely on the grounds that it served as a means of “harassing” Mr Corcoran?Jun 22 00:46
schestowitzSecondly, even if one assumes that the 2016 litigation was not frivolous (eg on the grounds that the plaintiffs were VERY poorly advised), is it utterly impossible to reach the same conclusion for the second case, filed in 2017. Further, the situation is even worse for the appeal. Having lost twice on the same (procedural) grounds, the plaintiffs would have known the high burden on them to overcome the procedural defects … but yet theyJun 22 00:46
schestowitzchose either not to address the issues, or to attempt to adduce evidence that was not directly relevant. What else can one call this but abusive (or “frivolous”) litigation?Jun 22 00:46
schestowitzThirdly, how is it that information from the USB stick was admitted into evidence? As I recall, that stick was taken from Mr Corcoran without his permission. This would ordinarily be called theft, making any material on that stick inadmissible (as being fruit of the poisoned tree). Did the court address this point? And what about the means by which the plaintiffs became aware of the defendant’s possible involvement in the alleged “Jun 22 00:46
schestowitzdefamation”? Was the court unconcerned by the possible commission of (data protection) offences by or on behalf of the plaintiffs?Jun 22 00:46
schestowitzThere are also “internal” questions for the EPO. Many of these stem from the fact that, as concluded by the Landgericht München, the “evidence” against Mr Corcoran was, at best, circumstantial.Jun 22 00:46
schestowitzUnless the EPO intends to ignore the ECHR completely, then it is incumbent upon them to presume defendants innocent until proven guilty. Unfortunately, and as we all know, that is most definitely not what happened in the case of Mr Corcoran. Indeed, it is beyond doubt that persons within the EPO management deliberately launched, via the German press, an ad hominem attack on Mr Corcoran (remember the “weapons” and “Nazi memorabilia”?).Jun 22 00:46
schestowitzWe now know for certain that the (defamatory?) allegations in that press article bear no relation whatsoever to the misdeeds of which Mr Corcoran was accused. This leads to the inevitable conclusion that the statements made to the press formed part of a smear campaign against Mr Corcoran.Jun 22 00:46
schestowitzAt the very least, this merits an independent investigation, focussing upon establishing the facts (and NOT the order of events according to Monsieur le President) and making recommendations for appropriate adjustments to the governance of the EPO. The remit of such an investigation should also encompass the “external” actions of the President and his allies in connection with the Corcoran case, in particular the leaks to the press andJun 22 00:46
schestowitzthe conduct (and funding) of the private litigation.Jun 22 00:46
schestowitzThe trouble is that it is not clear who would be capable of conducting such an “independent” investigation. The AC has already demonstrated itself to be complicit – by (deliberately?) not asking more probing questions of the President, and by retroactively condoning the President’s breaches of the EPC (including taking no action over the attempt to interfere with the independence of the Boards of Appeal).Jun 22 00:46
schestowitzPerhaps this is a project for the new President? Whilst this might not be a pleasant task, it is clearly essential in order to restore public (AND judicial) confidence in the integrity of the EPO.Jun 22 00:46
schestowitz"Jun 22 00:46
schestowitz"Jun 22 00:46
schestowitzThank you very much for digging out and translating the court decision.Jun 22 00:46
schestowitzBut now I wonder what the whole story was about. The President went to enormous efforts and took considerable risks to dismiss Mr. Corcoran. We know that for a fact.Jun 22 00:46
schestowitzBut it is now clear that Mr. Corcoran wrongdoings, if any, cannot have been really serious offenses. Does that mean that the whole dismissal was a set-up?Jun 22 00:46
schestowitzWe know that other people were dismissed: suepo officials. In their cases, it seems that the whole process was a set-up. We have the ILO decisions showing that the accusation of harassment was constructed over a single e-mail, for example. Of course, it makes sense to dismiss suepo officials if one is a dictator and want to set up an atmosphere of fear.Jun 22 00:46
schestowitzDoes this mean that this whole story was also set up to frighten the whole of DG3? We will probably never know what was the real reason, but that is a possibility.Jun 22 00:46
schestowitz"Jun 22 00:46
schestowitz"Jun 22 00:46
schestowitzOn the subject of bringing the EPO back to respect for the Rule of Law, Attentive writes:Jun 22 00:46
schestowitz“Perhaps this is a project for the new President? Whilst this might not be a pleasant task, it is clearly essential in order to restore public (AND judicial) confidence in the integrity of the EPO.”Jun 22 00:46
schestowitzThe operative word here is “perhaps”. Given that, according to “Cynic” above, this higher national court condemnation of EPO management issued not this year but last: “this decision came on 6.11.2017”, and how the AC has conducted itself since then, I am somewhat pessimistic that the incoming President is going to find from the ongoing Administrative Council any appetite at all to bring the Office management in line with the RuleJun 22 00:47
schestowitzof Law.Jun 22 00:47
schestowitzThe rotting fish stinks from the head. In the case of supra-national bodies like the UN or FIFA, western European Member States can shrug their shoulders, lament the all-pervasive corruption, plead that they are out-numbered by Member States outside Europe, and conclude that there is nothing they can do. But the EPO isn’t like that, is it?Jun 22 00:47
schestowitzIn the case of the EPO, the head on the body is the AC. Does the body smell? Even just a bit? What do you say, Admin Council Member States? What are you going to do about it?Jun 22 00:47
schestowitzOn an optimistic note, if BB can wrap a spineless AC round his little finger, so can Mr Campinos do that too, if he is minded to. Can he not make a new Pact with the AC, to make a fresh start. I advocate starting with a purge of all those higher management types who are unreformed fans of BB’s methods.Jun 22 00:47
schestowitz"Jun 22 00:47
schestowitz"Jun 22 00:47
schestowitz@ attentive Observer writes:”in spite of all efforts put to light by the Leader Maximo to increase the perception of independence of the Boards.”:Jun 22 00:47
schestowitzWell the transfer of DG3 to Haar cost a fat 2 digits amount of million EUR of good old applicants’ money (the price of mismanagement since Battistelli did it as a smoke-screen to cover the tracks of his erratic actions (which de facto put the question of possible lack of independence under clear light).Jun 22 00:47
schestowitzFor what result?Jun 22 00:47
schestowitzNone since your point is valid: DG3’s budget remains dependent from the president and the damages done to DG3’s reputation (with the active support of the Council) will probably not be reversed by later whilst re-instating Mr Corcoran soon (I hope to be wrong on this one).Jun 22 00:47
schestowitzAll this is very sad but indeed the next president soon to arrive will perhaps do better.Jun 22 00:47
schestowitzOne of the main issue for Mr Campinos is that all top managers responsible for the current EPO debacle (not only in DG3 but overall) have been placed at key positions all across DG4, DG5, DG1, presidential office, investigative unit etc.Jun 22 00:47
schestowitzThey will still be in place after Battistelli’s departure.Jun 22 00:47
schestowitzSo cleaning the Augean stables of the Office will only be possible, IF and only IF, Mr Campinos gets rid of them (or they will of course continue to act in collusion first to protect themselves then to protect Battistelli’s legacy since he made them and they owe him). They are not many but will Mr Campinos have the guts to take the only decision which is to be taken: hold them responsible for their abusive and illegal actions and draw theJun 22 00:47
schestowitzlogical consequences?Jun 22 00:47
schestowitzOne only has one chance to make a good first impression. Mr Campinos will have to act – and be seen to act – to restore the severe damages or else, it will only be more of the same.Jun 22 00:47
schestowitzLet’s hope Mr Campinos remembers this for the sake of preserving the EPO.Jun 22 00:47

schestowitzDear Mr BauschJun 22 00:47
schestowitzMany thanks for this extraordinary piece of information.Jun 22 00:47
schestowitzThe FCC is indeed watching, and the Corcoran saga alone is ample evidence that there is no judicial independence anymore in the European Patent system.Jun 22 00:47
schestowitzI don´t expect the AC to offer any apology. They are well aware of their huge reponsibility in Mr Corcoran´s situation and they seem to – wrongly – believe that the only way for them to avoid being held accountable is to destroy him entirely, mentally and physically.Jun 22 00:47

The downside was having to use a Windows computer to present. schestowitz"Identifying precisely what led to the demise of the LiMux project is difficult. Last year consultants Accenture and arf highlighted various problems with IT at the council, in particular in how long it took to update software, resulting in “obsolete, partially unsafe, usually extremely cumbersome IT, leading to lots of wasted time and productivity”.Jun 23 20:19
schestowitzHowever, neither LiMux nor LibreOffice were pinpointed as the source of these problems, with the consultants instead laying the blame on the fragmented nature of how IT is managed at Munich, with responsibility split between more than 20 separate organizations throughout the city. schestowitz“Unwarranted surveillance” is surveillance without a proper 4th Amendment warrant.Jun 23 20:25
schestowitzMake knowing that unwarranted surveillance is happening but not reporting it to the police at the soonest possible moment a crime (not a tort) with a mandatory minimum prison sentence. Costs of the trial and imprisonment must be borne by employers if the perps are employees surveilling as part of their jobs.Jun 23 20:25
schestowitzMerchants can keep records until delivery and payment have been verified. To enforce warrantees, forgery-resistant receipts can be issued (possibly cryptographically signed, for online purchases).Jun 23 20:25
