Breakdown of the Rule of Law and Patent Law in the European Union (EU)
Dictatorial tendencies, backed by billionaires, are becoming "normalised"
For many reasons, aside from the UK leaving the EU, the UPC or Unitary Patent is illegal, unconstitutional, and it was rammed through in violation of several treaties. All this is well documented. Put bluntly, it was and still is an act of corruption. It's not some accidental thing; it is very much deliberate and bribed politicians played a role in it. The EU has enabled EPO corruption to spread deep into the EU, so at this point it is actually complicit. It discredits a lot more than the EU and the patent system.
Now, the readers tell us that the "UPC denies asking questions to CJEU about its own illegality". It already did a a lot of other illegal things, including trying to impose itself on a post-brexit UK. Set aside the issue of conflict of interest at every level, including judges (who work "part time" for the very same companies they decide on).
What has the EU become?
We spoke to the FFII about this. "Will try to make a press release," they said. "This is insane."
Later this week we'll also show how the EPO violates the European Patent Convention (EPC, 1973). What next, "gig workers" as patent examiners?
"As of January, the salary adjustment in Germany (+1.2%) will be insufficient to cover the increase in pension and healthcare contributions (+2.2 percentage points) resulting in a pay cut of -1%," the EPO's Local Staff Committee Munich (LSCMN) said the other day.
The EPO cannot recruit suitably qualified patent examiners this way, let alone retain them. Many have already left in droves over the past decade and a half, fleeing the tyranny of Benoît Battistelli and António Campinos, who in direct defiance of the law compelled examiners to grant many European software patents - i.e. patents which are both illegal and undesirable. █
