The
Garrett and Graveley claims are very similar; it's very
much crystal clear that the majority of their papers
are
lazy 'copypasta'; this laziness results in many hours and high
lawyers' fees (at minimal effort to those who fling them over for
foreign litigants). In this case,
third parties paid the legal bills - a serious
matter for sure. Garrett
cannot afford 85+ KG of legal papers, not even if Graveley
(living in his dad's home) "does his share" and contributes to the
SLAPPs. The Microsoft pot/hat relies on common enemies. The aim it
to muzzle, censor, get "revenge".
NDAs can be expanded (the acronym) to "non-disparagement
agreements", not just "non-disclosure agreements". What we have
here is nothing less than a gagging attempt, initiated by
violent people.
Last year an American Microsoft employee who was arrested
and
charged for strangling women (his
own attorney confirmed this) asserted - via
hired guns in London - that it was "MALICIOUS FALSEHOOD" to
mention this:

Only a week or so earlier
he made a "generous offer" (a threat really!) after
he had begged for removal.
Garrett and Graveley had spoken about this, according to
Garrett who was under sworn oath (he swore on the Bible, I saw it
in my own eyes and so did more than a dozen people in the
courtroom*). He basically contradicted several prior
statements made to several High Court judges on numerous
occasions, which means he and 5RB (via Brett Wilson LLP) had issued
and repeated false statements to the Court. What's at stake here
isn't "misleading" but
contempt or even
perjury.
In July 2025,
in my counterclaim, I responded to the above as follows:
12. This is a spurious claim, which is denied and is moreover an
abuse of process with the aim of censorship.
12.1. The case is of significance for numerous reasons, which
may also make it unprecedented in many regards, at least in the UK.
Microsoft staff tries to undermine free press in a very distant
country (an ocean apart). "It might be the first such case," said
an informed person "but Microsoft makes heavy use of NDAs +
non-disparagement clauses, so it is theoretically possible that
others have been silenced permanently first. Though I do think that
Techrights + Tux Machines may be the first such case. Thus it is
even more important to document."
12.2. It is also vital to challenge and resist the censorship
attempts, then properly document everything for other people to see
and hopefully learn from.
12.3. "Along those lines," said the above person, "it would be
very useful to prove the existence of NDAs in their contracts with
public institutions. That'll require a whistleblower somewhere." As
no malicious falsehood occurred and was spread, and the Claimant is
required to provide strict proof, it would be ambitious to assert
that somehow these mere allegations of “malicious falsehood” are
applicable worldwide, or have a global scope based on the mere
allegation itself.
13. This is patently false and thus denied. The articles were
all authored in good faith, based on supporting material and
insistence on the underlying truth. It contains acceptable
statements. At no point was anything false knowingly published, nor
was anything published falsified (or proven false at any point
later).
We'll keep it short for today as it's Sunday and we relax in
weekends.
Censorship of this kind isn't unprecedented. Less than a
year ago the same legal team was
blasted by a High Court judge over it. This is lawfare. This is
gaming of the system. They are trying to "bend" (cheat) the law.

* Earlier in the same month the
Allison Pearson case had an Order issued by the same Judge
(C-R). Pearson was advised and represented by the same
solicitor as ours (background in BBC [1, 2, 3, 4]) and
won the case in a TPI two days ago. It has some similarities
and it is worth saying these deplorables did the same to Rianne and
I (sent cops, on false pretences, even from another continent!), on
the same year they repeatedly terrorised our webhost in a
mind-blowing effort to just take down tuxmachines.org (active since
2004) and techrights.org. Now the police is dealing with "threats
to kill" (their assessment of the messages sent to us from burner
accounts; see
Part I,
Part II,
Part III,
Part IV). We'll be writing a great deal about this in the
future.
