The "hired guns" are already (proactively) trying to undermine our intention to appeal (escalate to the Court of Appeal).

As we said in the previous parts, the vexatious litigant who collaborates with Microsoft's Graveley (a strangler arrested and charged for it, we are now suing for it) "did not even show up for his own hearing" - just like Graveley, who never ever shows up. He was instead hiding under some bridge (maybe London Bridge) nearby. We are left or led to simply assume he was afraid to see me (or a veracious Rianne). But why speculate? Based on his own barrister, he was left rattled after I had cross-examined him last October.

Last week we submitted what had to be submitted and made it known that we are likely appealing the decision, not because of what most people might assume; it is important to establish, in British caselaw, that Gemini is not the Web, GemText is not HTML, and capsules are not websites. There are other reasons too.

Apropos appeals, last year as Litigants in Person (LIPs) the importance of establishing scope and clarity in any order was explained, as the vexatious litigant made it very clear that to him, the aim was not to remove a couple dozen pages complained of but instead to take offline almost half a million Web pages. This sort of overreach and abuse of process persists even this week. We'll say more about this tomorrow or on Sunday.

The intent to rectify the matter isn't new to anyone as our representatives - the two barristers - made it known almost a fortnight ago. If the matter is dealt with further, more so at a higher level, it'll help establish greater recognition of a diversity of hypertext or document exchange over the Net. The Web is only a small subset of the Net, accounting for only a small portion of all Internet traffic.

Consider this very simple question: what % (percent) of "the Net" is "www"? What does the Web mean to the Net? Since Microsoft called its first major Web browser "Internet Explorer" (an intentionally confusing if not misleading name) many came to assume that the Web was "the Internet" and the only thing on "the Net" was Web pages. Even back then FTP was commonly used and LANs had file exchange protocols in "real-world" use, even predating the Web by a very long time. There were and there are still several widely-used VoIP protocols and such (video calls could be done in the 90s, they are and were at the time more bandwidth-intensive because of simpler compression standards - a hardware limitation and granularity being a factor). Landlines are being replaced by some of those heavily used protocols. Landlines are fast becoming just Internet gadgets attached to phone-billing software - one that overcharges people while reducing costs to operators. In the UK, the old phone sockets are being phased out. Everything is moving "online" (in the Internet sense). So we have DNS, SMTP, SSH, Gopher, WWW (HTTP / HTTPS), Gemini Protocol, WAIS, I2P, Tor, BitTorrent, FTP...

According to this report from 2019 (7 years ago), "HTTP Media Stream accounts for 23.8% of global video streaming traffic, in front of Netflix and YouTube." Before the hype about slop (mis-classification, pure hype) we could sensibly measure human traffic associated with HTTP for actual pages (not streams over HTTP, which already got split into three [1, 2, 3]). In the UK, not many sites are active (many got outsourced to "apps" or "webapps"). Pure HTML markup documents account for a small fraction of total global Internet usage - less than 1% by data volume. So what to do or how to treat over 99%, which is the rest? This is a very legitimate question to ask. No assumption need be made in answering it.

On top of that, most Web pages are not accessible to the public and are thus what the media might call "dark web"; on the Web (e.g. Web search), everything focuses on the WWW now, even if other protocols are in use to a lesser extent (the Web is Web-centric, as one might expect). Some firms say that about 95% of the Web is "dark web", e.g. intranets.

People fascinated with the "invisible" sides of the Web overlook the "invisible" sides of the Net, which includes botnets, military activities, or a combination of the two. IPFS and Bitcoin and all that "blockchain" nonsense is a drain on the Net and yoke/burden to switching equipment, exceeding "meaningful" traffic (like people looking up information online) by orders of magnitude. "Online" (the Net), bot traffic now outpaces humans'. We cannot ignore this when examining statistics, e.g. number of views of some publication/s. █
