We don't know what Internet Archive (IA) agreed to. We just don't know. Part of the agreement is, we're not permitted to know. The secrecy in its own right is a big problem. It's a trust problem.
As an associate put it, citing this "Confidential Settlement", this is "big trouble," as "IA was not declared an outright winner..."
Capitulation is not winning.
