Donald Trump Wants a Patent Maximalist in Charge of the USPTO

Summary: Having researched the background of Lee’s likely successor, we are unimpressed and worried about another potential dark era

THIS morning someone sent us this important report which we had already included in our daily links. It suggests that, if Trump gets his way (as he typically does), the USPTO will be run by a law firm (patent ‘industry’), at least sort of, as opposed to technology companies. That’s what it looks like at least based on the background of Iancu, who is “currently the managing partner of Irell & Manella LLP, a Los Angeles-based law firm that focuses on intellectual property law,” according to The Hill. There’s more behind paywalls [1, 2] and computer-generated videos like this.

“It suggests that, if Trump gets his way (as he typically does), the USPTO will be run by a law firm (patent ‘industry’), at least sort of, as opposed to technology companies.”To better understand if this is bad news or good news we turn to the blogs of notorious patent maximalists; if they’re happy, it’s bad news for technology; if they’re upset, then it’s certainly good news. Well, Crouch did not say very much. Perhaps he knows too little about the person or he is just eager to put out there the information as soon as possible.

“This, to us, means that Iancu (if appointed, not just nominated) would be friendly towards parasites.”What worries us is that rather than a technical person (like Michelle Lee) being put in charge it’s basically a law firm that’s behind a lot of litigation. As Watchtroll put it today: “The fact that Iancu represented TiVo, a patent owner, against big tech in Silicon Valley will undoubtedly lead to a warm reception in certain patent owner segments of the patent community. Iancu and his firm have a reputation for suing big tech while representing patent owners, and he himself also served as counsel for San Jose-based touch feedback tech firm Immersion Corporation in a patent infringement suit against Japanese tech conglomerate Sony Corporation (NYSE:SNE) involving video game controller patents which ended up netting $150 million for Immersion in March 2007.”

These are patent bullies and trolls. We mentioned TiVo and Immersion Corporation many times before (always in a negative context). This, to us, means that Iancu (if appointed, not just nominated) would be friendly towards parasites. Whose idea was it to nominate him? Who told Trump to do this? He apparently applied for this position, so Mr. Ross (Commerce Secretary) is to blame.

  1. [Meme] Fluffy Staff

EPO President António Campinos is failing to ‘contain’ the media after less than 4 years at the Office, just like Benoît Battistelli around 2014

  2. Kluwer Patent Blog Belatedly Gives EPO Staff a Voice

There are at least 2 bloggers — if not 3 people — at Kluwer Patent Blog who air grievances of EPO staff; in addition, many of the comments there blast EPO management and Team UPC and it helps change the perceptions long shaped by bribes and blackmail from EPO management

  3. [Meme] Fluffy President

Prepare for more puff pieces and fluff from President Fluffinos, who has commandeered the EPO‘s official Web site for self-serving whitewash and promotion of illegal agenda like European software patents and a kangaroo court to approve those (UPC)

  4. Blaming Patent Examiners Who Respect the Law

The latest comments here are quite revealing; the EPO not only breaks the law with impunity but it also challenges the very legal system (like courts) with total impunity; Benoît Battistelli and António Campinos are, in that regard, no better than Putin, just more temperamental

  10. Visual Proof That Twitter Very Likely Faked Its Magnitude the Moment Musk et al (KSA, Ellison and so on) Wanted to Buy

There's a very compelling case for the allegation that Twitter is defrauding shareholders and participants in the platform; Twitter is a lot smaller than it used to be (fewer people are actively involved), it is losing money, and it is so desperate to be acquired that it's shamelessly faking traffic

  18. EPO Celebrates Software Patents Again, Dubbing Them 'Hey Hi' (AI) and '4IR'

The ludicrous state of the EPO is demonstrated by yesterday’s puff piece about “four million” (merely requests for monopoly in Europe; most come from outside Europe) and L’Oréal, which claims to have “invented” something that was already done in the 1990s if not the 1980s

  19. [Meme] EPO's Monkey Business: Lowering the Patent Examination Bar

As we shall show in a moment, EPO President António Campinos has lowered the quality of patents and applications; sooner or later he might outsource the job to ‘livestock’

The overconfident chiefs of the U.S. Patent and Trademark Office (USPTO) and EPO might love speaking about COVID-19 (in relation to patents), but they do not take it seriously themselves

  23. The General Consultative Committee of the EPO Exposes a Disaster and a Lack of Genuine Dialogue

The General Consultative Committee (GCC) at the EPO deals with unlawful proposals from António Campinos (he’s happy to violate laws, constitutions, protocols, conventions, just like Benoît Battistelli did) and once again the abuses by managers is covered up; it’s as if the Office is run by unaccountable gangsters who arrogantly curse at everyone whilst insisting they’re the nicest people ever

  24. The Latest Letter to Josef Kratochvìl and the Heads of Delegation of the Administrative Council of the European Patent Organisation

A week-old letter from the Central Staff Committee (CSC) to the Administrative Council of the European Patent Organisation highlights the nature of a crisis; there's no genuine dialogue and staff of the EPO (i.e. the scientists who do all the actual work) is constantly under attack

  25. [Meme] The Recordings Must Have Accidentally Been Lost While Breaking the Rules

The EPO‘s “nicest” chief, Monopoly Tony, won’t even mention the recordings…
