USPTO May Get a New Director Tomorrow, But It’s Not Good News

Posted in America, Patents at 10:01 am by Dr. Roy Schestowitz

Andrei Iancu

Summary: It is expected that Andrei Iancu (above) will become the Director of the US Patent and Trademark Office (PTO), probably late tomorrow, but why the silence on the likely impact he would have on the Office?

THE USPTO has been headless for a long time, except for its interim leadership (Director). Trump’s nominee is a cause for concern because he's from the patent microcosm, putting aside more personal aspects (such as him being born in the Soviet Union and being picked by Trump's official who is most closely connected to Putin's family); we don’t want to use the McCarthyist tactics, so instead we focus on Andrei Iancu’s professional background.

“The writings are on the wall and Iancu in this position would likely exacerbate things.”Is a private patent law firm about to ‘take over’? According to this, “[t]he USPTO should have a new director within the next few days. President Trump nominated Irell & Manella partner Andrei Iancu for the position last fall. A vote is now scheduled on the Senate Floor for late Monday. So far, no Senators have voiced any direct opposition to the nomination.”

Have any Senators bothered researching this matter? Have any corporations (or their front groups) bothered commenting on the matter? If not, why not? Are they just trying to be diplomatic in case he gets appointed? The writings are on the wall and Iancu in this position would likely exacerbate things. It’s bad enough as it is and it can only get worse after the PTO amassed many patents of questionable quality (reducing legal certainty).

“It’s bad enough as it is and it can only get worse after the PTO amassed many patents of questionable quality (reducing legal certainty).”It is worth noting, based on another new post, that while the EPO is a milking cow for Germany the USPTO is anything but (for the US). It’s cash negative (losses). “Several USPTO fees were modified in January 2018,” it says. “I’ll note here that the America Invents Act (AIA) of 2011 substantially expanded the USPTO’s fee setting authority. However, that authority is set to sunset in September of this year (2018).” In relation to taxes there’s more to be said. What will the USPTO be like for ordinary people unlike massive corporations, some of which use patents merely as a tax evasion mechanism? Vis-à-vis tax evasion, mind the new report below (from Switzerland). It covered Patent Boxes, which are infamous for their utility among very large tax evaders.

Abolition of the privileged regimes (holding, mixed company, domicile company, finance branch and principal rulings):

These special regimes, which are only applicable at cantonal level, will be abolished.
    Patent box

Profits from patents and similar rights will be segregated from other profits and taxed at a lower rate at the cantonal level. The cantons can determine the amount of such relief, the maximum relief being 90%. The implementation of the patent box will be in compliance with the patent box as defined by the OECD. Profits stemming from patents and similar rights can be included in the patent box. Software as such cannot be patented according to Swiss laws and accordingly cannot benefit from the relief of the patent box. Computer-implemented inventions including software can however be patented in Switzerland and benefit from the relief. Additionally, software patented in foreign jurisdictions where this is possible may benefit from the relief.

  1. Former Microsoft Employee on So-called 'Journalists' Being Blackmailed by Microsoft

Mitchel Lewis, a former Microsoft employee, remarks on Mary Jo Foley being 'punished' by Microsoft for not mindlessly publishing Microsoft propaganda (we remarked on this before as she had spoken to me about this over a decade ago)

  4. Ubuntu and Fedora Project Serving Microsoft

The Ubuntu 'community' as well as the 'community' component of Red Hat (IBM) don't view Microsoft as a rival; over a decade ago Mark Shuttleworth accused Microsoft of "extortion" and "racketeering" (his words), but now he's paid to change his tune

  5. (Don't Let's) Throw Caution to the Wind

"As it will become crucial to explain, the effect of all this dancing around truth and reality was to transform a volunteer force primed to bring freedom to users into cheap labour for an industry that exploits everyone in it -- all the way to the very top of Open Source itself."

Today seems an apt time to remind readers that IBM participated in the creation of the only bombs ever to be dropped in a war (not tests) and this tradition carries on because IBM is still profiting from it, to this very day (countless billions made by IBM during the Cold War too)

  12. Our Collective Privacy is Under Unprecedented Attacks and Privacy is Now Conflated With Bad Hygiene, Not Just Criminality

At warp speed the "War on cash" or "War on anonymous transactions" is moving ahead; now that COVID-19 infects a lot of people we're led to assume that mass surveillance saves lives not because of counter-terrorism but because of contact-tracing or whatever (in practice it's hardly effective, but it's conditioning people to give up any remnants of their privacy)

Don't let well-meaning concepts such as "Social Justice" become mere buzzwords or tools of corporate propaganda (greedy people's objectives disguised as populism)

  15. Site Upgrades Likely Coming Soon

After more than 28,000 posts are published it might be time to move from the WordPress x.9.x LTS to something newer (5.5 is about to be released); we explain why it’s not as simple as it might first seem

  16. Focus on the Big Issues, Not the Words

The pattern that is emerging in recent months if not years is that words hurt and therefore contributors to code must shut up about injustices, including corporate misbehaviour

  21. [Meme] RMS Succeeded by a Microsoft Sponsor

Congratulations to the FSF, which elected a president almost a year after pushing RMS (its founder) out; but questions need to be answered by the new president, who apparently sees nothing wrong reinforcing the Microsoft monopoly, participating in a PR ploy designed to distract from the notorious ICE contract, and even paying Microsoft (as if it deserves the money)

  22. Controlling Your Computing

  29. SUSE is Still Pushing Microsoft Proprietary Software and Bragging About the Novell Patent Collusion With Microsoft

SUSE seems to have learned no lessons after the aftermath of its (or Novell’s) Microsoft patent scam, which had been negotiated partly by Miguel de Icaza (now working directly for Microsoft) before causing Novell to collapse and offload its patents to Microsoft (‘TikTok operandi’ or asset stripping); the past cannot be left behind if SUSE — like Novell — celebrates and perpetuates that past

  30. Release: 29 Pages of Internet Access Report About Pedophile Working for Bill Gates at His Home

As we’ve found nothing too sensitive in the document, today we’re finally disclosing and publishing the second release (first one published yesterday); this includes network addresses used on the devices of the engineer of Bill Gates, who had a laptop and external hard drives (portable) with plenty of child pornography (imagery and videos)
