Conflicto en la Oficina Europea de Patentes: Battistelli se sale con un tirón de orejas



Benoît Battistelli permanece en la oficina por ahora. Sin embargo, el Consejo Administrativo de la Oficina Europea de Patentes [sic] ha puesto al Presidente gas claras para su futuro manejo de la oficina. Esto de acuerdo a un comunicadoque fue publicado ayer. El cuerpo supervisor admitió publicamente por primera vez que hay un conflicto muy profundo entre el President Battistelli y los sindicatos, y ha llamado a ambos lados a buscar una solución amigable.

Battistelli este en un amargo conflicto con el sindicato SUEPO. El es responsable por cuatro controversiales procedimientos disciplinarios contra tres representantes de la union y un juez Irlandes. La Oficina también está luchando contra la reforma estructural de una mayor independencia de sus tribunales legales, y de las cortes de apelaciones.

La reunión de dos dias de los 38 estados miembros de la Organización de Patentes terminó ayer. En el período previo a la reunión se había especulado públicamente que Battistelli renunciaría, después de que el comité ejecutivo del Consejo de Administración había intensificado internamente la presión sobre Battstelli. Los periódicos alemanes y holandeses informaron que era sólo una cuestión de decidir cuanto dinero se le daría para que se vaya. Por el contrario, la Juve se enteró que los delegados influyentes que el Consejo de Administración harán un intento más en la búsqueda de una solución pacífica, pero en condiciones claramente definidas, como ahora se ha confirmado.

Ambos lados fueron notificados

“La resolución pone en obligation al Presidente y hace claro que el es responsable por restaurar in clima de paz dentro de la EPO” dijo el Dr. Philip Scholz, Vocero del Ministerio Federal de Justicia y Protección al Consumidor, refiriéndose a estos eventos. Sin embargo, de acuerdo a la resolución, no sólo Battistelli es quien esta bajoe esta obligación, pero también su archienemigo, la principal unión SUEPO. No ha habido diálog real entre ambas partes en tiempos reciéntes. El conflicto llego a su punto máximo cuando Battistelli suspendió a tres líderes sindicales, incluyendo a Elisabeth Hardon, quien es de los Países Bajos.

Ahora los estados miembros de la EPO demandan que el Presidente alcanze un arreglo con las uniones, sin precondiciones or exclusiónes. Las uniones han consistentemente demandado que las investigaciones contra los lideres de la unión sean suspendidas antes de que entren a cualquier acuerdo. El Consejo Administrativo respondió a las criticas públicas de estos procedimientos, y en particular al criticismo de los métodos empleados por la Unidad de Investigación interna, y requirió a Battistelli para “asegurar que los procedimientos disciplinarios no sean sólo justos sino que también sean vistos siendo justos”. La JUVE entiende que el Presidente fue ordenado a someterse a los procedimientos, arbitración y mediación a una revisión externa. Esta propuesta pareció en vez en una forma diluída en el comunicado del Consejo del Comité Administrativo.

El Consejo Administrativo explícitamente pidió al Presidente venir con propuestas para mejorar los procedimientos y para mantener informado apropiadamente al Consejo del Comite Administrativo en casos disciplinarios. Esto incluye revisando las Regulaciones y las Guías de Investigación de Empleados.

Battistelli dijo a la JUVE: “Por el lado de la Oficina, comenzaremos con la requerida revisión de interna Guías de Investigación y los procesos disciplinarios. En paralelo, una firma consultante lanzará un estudio con la participación de los Representantes de Empleados sobre las reformas implementadas los últimos años. Nos gustaría discutir los resultados de este estudio en una conferencia el Otoño, junto a los Representantes de Empleados, las uniones de la EPO, los estados miembros, y otros grupos interesados.”

El Consejo Administrativo también dió un mensaje claro a las uniones. Ellos deberían trabajar constructivamente y rápidamente con la gerencia de la Oficina, sin precondiciones, hacia un acuerdo. La SUEPO todavía esta discutiendo su respuesta a los últimos eventos, y no estuvo disponible para dar una declaración oficial. Sin embargo, fuentes cercanas a ella sugirieron que la propuesta de contratar a un mediador externo en los procedimientos disciplinarios pueda proveer una oportunidad para el progreso.

La Reforma de los Jurados de Apelaciones deben ser aceleradas

La reforma estructural del los Jurados de Apelaciones deberían ahora ser impulsadas rápidamente. El tribunal interno de la EPO decide en la legalidad del otorgamiento de patentes. Sin embargo, ha sido reciéntemente demostrado que no es lo suficientemente independiente de la Oficina. Battistelli debe presentar al Consejo Administrativo con nuevas propuestas de reforma para Junio, tomando en cuenta los cinco guías requeridas que el mencionado Consejo emitió en Diciembre, así como los resultados de una apreciación legal llevada a cabo por el Prof, Dan Sarooshis. La reforma entonces debe ser implementada rápidamente.

La reunión del Consejo Administrativo también resulto en la nominación de dos nuevos Presidentes de las Cortes de Apelaciones y cuatro miembros adicionales de las mencionadas cortes, así como un miembro externo del Ampliado Jurado de Apelaciones. Estas posiciones habíán estado vacantes por un tiempo. En adición, Jesper Kongstad fué confirmado como Presidente del Consejo Administrativo por tres años más desde Julio del 2016.
