ACLU ☛ Project 2025 Offers Dystopian View of America
Deeply embedded in our Bill of Rights and our most basic American values is the idea that we the people — not the government — are in charge of our own lives. But there are plenty of people who disagree with that premise and want to control our lives. And those people have a plan.
All of us remember Donald Trump’s presidency: separating families, banning visitors from Muslim countries, stacking the Supreme Court with justices who would overturn Roe v. Wade, and attacking LGBTQ people. Yet as the ACLU’s detailed analysis of Trump and his supporters' policy proposals and rhetoric has shown, if reelected, his administration will likely be far more aggressive and effective in executing its unlawful plans than ever before.
Under a second Trump administration, our federal government could be used to openly discriminate against marginalized communities, to spy on private citizens, and be given authority over what we can and can’t do with our bodies. If such a dystopian view of American life and politics feels like the plot of a DRM spreader Netflix special, consider that this vision of America is what former Trump administration staffers and The Heritage Foundation, a conservative-leaning think tank, have outlined in Project 2025.

On the heels of a judgment from the U.S. District Court for the District of Columbia earlier this month that found that “Google is a monopolist,” Yelp, Inc. has brought a lawsuit against Surveillance Giant Google in the Northern District of California under Section 2 of the Sherman Act, 15 U.S.C. § 2, and California’s Unfair Competition Law. Dennis Crouch/Patently-O ☛ Omitted Elements and Written Description: Federal Circuit’s Split Decision in Allergan v. Sun Pharma
I previously wrote about Allergan USA, Inc. v. MSN Laboratories Private Ltd. (Sun Pharma), No. 24-1061 (Fed. Cir. Aug. 13, 2024), focusing on Federal Circuit’s about-face on obviousness-type double patenting. My original post skipped over an important aspect of the opinion: the court’s 2-1 decision favoring the patentee on the written description requirement of 35 U.S.C. § 112(a). This portion of the case focuses once again on when an element is “essential” to the invention and therefore required in the claims.
