Sumario: Los últimos eventos en los Estados Unidos,donde el número de juicios son altos, la potencia de patentes de software declina (por lo menos en las cortes), y Microsoft tambien usa el potencial de la extorsión de patentes, simplemente como sólo los trolles lo hace (mostrados arriba Bill y Nathan, dos compadres de Microsoft and Intellectual Ventures, respectivamente, aunque hay conecciones financieras fuertes y claro overlap de finanzas)

DE las 47 demandas de patentes presentadas hoy, 37 fueron sometidas por trolles de patentes,” dijo United 4 Patent Reform (eso hace el 79% de los juicios). Sin duda es un asunto de importancia, pero €¿cuántos de ellos fueron hechos usando patentes de software que la USPTO ama tanto a pesar de las resoluciones judiciales? Eso es un montón de demandas y no toma en cuenta cualquiera los arreglos secretos, que no sólo los trolls de patentes están obligando a sus víctimas, sino también empresas como Microsoft firma como una forma de ataque encubierto contra Linux.”

€¿Esta explotándo la burbuja de patentes o es simplemente optimismo prematuro? Eso es un montón de demandas y no toma en cuenta cualquiera los arreglos secretos, que no sólo los trolls de patentes están obligando a sus víctimas, sino también empresas como Microsoft firma como una forma de ataque encubierto contra Linux. Incidentalmente nuevos potenciales ataques de Microsoft contra Linux han sido traído a nuestra atención hace unas horas. Habiéndo destruído Yahoo, Microsoft ahora quiere sus patentes (simplemente como Novell lo hizo con CPTN). No hace mucho un artículo de BI, citando News Corp. (más que un tabloíde en este caso), afirmó: “El informe dijo que empresas como Microsoft, Amazon, Salesforce, y LinkedIn han seguido de cerca el proceso de ventas de Yahoo porque se dan cuenta del valor intrínseco de la cartera de patentes masiva de la compañía, que incluye 6.000 propiedades intelectuales en el campo de la telefonía móvil, datos y tecnología de publicidad.” Ya hemos visto com Microsoft hizo un arma de MOSAID (desde allí le cambió de nombre a Conversant, un financiador de IAM) usando las patentes de Nokia’s , después de que Microsoft había secuestrado a Nokia. Como notamos hace un par de dias, la Corte Suprema de China escreciéntemente preocupada de lo que ocurre en el espacio de litigación de patentes (China es tan leniénte como los US en cuanto se trata de examinación de patentes) y MIP acaba de escribir un reporte acerca de ello. Escribiendo acerca de PTAB, el Patent Trial and Appeal Board el cuál está inválidando un montón de patentes de software estos dias, MIP diceque esprobable ayudar a reducir el grado de institución de juiciosy que la “USPTO soltó un programa pilot” (la USPTO es un obstaculo que ponga en peligro alcasi cero control de calidad).

Seguro que parece como si en este momento los EE.UU. sigue siendo una plataforma demasiado madura para los trolls de patentes y la extorsión debido a las patentes de software, la facilidad de litigios (incluyendo la selección preferencial lugar/corte), y varios otros factores que hemos cubierto aquí antes. De acuerdo a este nuevo reportaje una "compañía de software de impuestos Jacksonville frustra la patente demanda por violación", pero que tiene un alto costo. Para cita: "Una compañía de software de preparación de impuestos Jacksonville ha salido victorioso en una demanda que afirmaba que violó las patentes de otra empresa de preparación de impuestos computarizada. "La demanda fue presentada en febrero de 2015 mediante la Aatrix Software Inc., con sede en Grand Forks, N. D., contra Greenshades Software Inc. reclamando que la firma Jacksonville infringió dos patentes. IAM probablemente quiere más de ellos por que ellos son los que le pagan.”

Tomen esto con un barril de sal por que proviene del sitio propagándista de Quinn (giro pro-software patentes), quien ahora acusa a las cortes de hacer un trabajo impropio porque obedecen a SCOTUS (Quinn, al igual que Kappos, piensa saber más de leyes que los Jueces, y ambos son pagados a lo grande por este vergonzóso giro).

Regresándo a IAM, resulta que el conchudo juego de Ericsson con los trolles de patentes se esta convirtiéndo difícil de seguir ya que la concha ha cambiado de nombre por tercera vez (la s patentes de Ericsson se convierten en Openwave, luego Unwired Planet, ahora algo más). Paracitar a IAM (que usualmente descuida decir lo que en realidad Unwired Planet es): "Hablando con IAM después de la más reciente decisión del Reino Unido, Teksler no dio indicios de que la posición de la empresa pronto cambiaría de manera tan dramática. Entre comillas no incluidos en la pieza blog publicado el 29 de marzo, afirmó que estaba a la espera de un juicio adicional del Reino Unido prevista para octubre, que se centraría en cómo Unwired Planet alcanzó sus tasas de licencia razonables y no discriminatorias.
