Dennis Crouch/Patently-O ☛ The First Precedential Patent Decision of 2024: Dexcom v. Abbott Diabetes Care
The U.S. Court of Appeals for the Federal Circuit has begun 2024 [2023] with its first precedential patent monopoly decision in DexCom, Inc. v. Abbott Diabetes Care, Inc., 2023-1795 (Fed. Cir. January 3, 2024). In an opinion by Judge Stoll, the court affirmed a district court decision denying DexCom’s motion for a preliminary injunction. The patentee had requested an order barring Abbott from pursuing its IPR challenges – based upon a forum selection clause that was part of a prior settlement between the parties. Judges Dyk and Hughes were also on the panel.

The month was dominated by the brain procedure my partner had, the weeks before and also after it. She is recovering slowly but it is taking a bit longer we were expecting, so we need to keep staying positive and try to not overthink it too much.

At work things where slow as expected but a highlight was the annual December lunch that again we did at La Marítima in the Valencia Port marina. As always, it is great to connect with workmates that live close but I actually don't see much, except a workmate that happens to live close and we take our kids to the same school.

Did I dream that movie?
I keep reminiscing of an anime movie that I would have seen as a teen or young adult (so, early 2000s?). It's set in a city where something like half the population is actually robots (or maybe genetically modified humans?). Those robots play various roles in society, but their main thing is that they are kind of a buffer for humans' emotional outbursts. They mediate some relationships, massage some egos, generally make people feel better, and it makes that society work really well.

It has come to my attention gemini://gem.librehacker.com/gemlog/starlog/20240103-0.gmi that the Antenna exhibited outright pro-Palestinian censorship. Of course, this is not good and now I will know what the Antenna is. I fully support the opinion expressed in Christopher Howard's article "Standing With Israel (publ. 2024-01-01)." As I previously wrote on the Station, the Palestinians are Hamas, which is, in essence, a paramilitary expression of the will of the population of the Gaza Strip.
