Summary: Another set of remarks about the BSA's lobby for RAND (notably on Microsoft's behalf) and a translation of an analysis from Karsten Gerloff into Spanish

OUR kind contributor Eduardo Landaveri has just translated "Battling the Hydra: FSFE work On Open Standards" in order for it to be distributed in south America. "Remember your site is not political," wrote Landaveri, "but the fight for Open Standards & Freedom always end up that way, because politicians allow themselves to be bribed by the big companies ignoring the needs of their own people. It happened with the United Fruit Company, the Cerro de Pasco Corporation, the International Petroleum Corporation just to mention a few. Those who denied these things happened are of the same breed as the Iranian dictator who denied the holocaust.

"Colonialism have morphed into a new dimension: Digital Colonialism. Proprietary standards are a way to intervene on the sovereignty of the nations. Those who control the standards and formats control their future, either the big companies or the nations themselves by the way of Open Standards and Free Software."

Luchando contra la Hidra de Lerna: El Trabajo de la FSFE en Estándares Abiertos

El viernes se publicó un análisis de la FSFE en materia de patentes y normas[http://www.fsfe.org/projects/os/bsa-letter-analysis.es.html], y lo compartió con la Comisión Europea. Esto fue en reacción a una carta [http://www.fsfe.org/projects/os/bsa-letter-ec.pdf], que había escrito la Business Software Alliance (BSA) a la Comisión en un último intento para erradicar los últimos vestigios de los estándares abiertos del Marco Europeo de Interoperabilidad. Hemos respondido a las alegaciones de la BSA, recogiendo los separa uno por uno.

€¿Por qué Estándares Abiertos materia de Software Libre

Aquí hay un poco de perspectiva a este episodio. Los estándares abiertos son importantes porque se puede implementar en cualquier modelo de software, ya sea libre o propietario. Cuando se utilizan estándares abiertos, los programas de competir por sus méritos y no en el número de usuarios que se las arreglan para esclavizar a sus formatos.

Por una norma que significa abrir, entre otras cosas, que puede ser aplicado sin restricciones, tales como la obligación de pagar una cuota de licencia al titular o dueño de la patente por cada copia que se hace del software. Tales "cánones" son una característica típica de las patentes de licencia de los llamados "(justo), razonables y no discriminatorios" ((F) RAND) condiciones. A veces se coordinan con los grupos de la industria, tales como Open Forum Europe. Si tenemos una agenda común, trabajamos juntos. Si no estamos de acuerdo, cada uno va por su cuenta. Tal es el negocio de la labor normativa.

Una Campaña Mundial Contra los Estándares Abiertos

Recientemente, la Business Software Alliance y sus amigos han estado librando una campaña total contra los estándares abiertos. La carta de la semana pasada fue sólo la última instancia de lo que parece ser un esfuerzo internacional coordinado por la BSA y sus amigos para llevar su mensaje a los responsables políticos. Al igual que la legendaria hidra de muchas cabezas, su gente luchando por sus intereses se parecen en todas partes. Durante el último mes o así, no dejaba de oír la misma rutina dondequiera que iba, siempre en palabras similares.

Un repaso, si no está familiarizado con la BSA: Destacados miembros de la BSA incluyen a Microsoft, IBM, SAP, Adobe, Siemens, y muchos otros [http://www.bsa.org/country/BSA%20and%20Members/Our%20Members.aspx]. La BSA es quizás mejor conocido por estadísticas favoritas [http://blogs.computerworlduk.com/open-enterprise/2010/09/bsas-piracy-numbers-less-than-they-seem/index.htm] sobre la copia ilegal de software, que rutinariamente afirman que todos los que usan software propietario sin licencia habría comprado una copia con licencia si la copia pirata no había estado disponible - un error conocido como el mito de "la venta perdida".

Esta vez, la BSA afirma que la mayoria de licencias de Free Software son compatibles con las licencias RAND ("justo, razonables y no discriminatorios") de patentes tal como la conocemos. Eso es claramente una tontería. Más del 85% de los proyectos de Software Libre se distribuyen bajo licencias que sean INCOMPATIBLES con las licencias RAND. La excepciones son la licencia de protección del Massachusetts Instituto de Tecnologia y licencias de tipo BSD.

Wilfried Grommen de Microsoft, sostuvo en el Foro de Gobernanza de Internet 2010 [http://www.intgovforum.org/cms/component/content/article/102-transcripts2010/707-154] que las licencias RAND son compatibles con los estándares abiertos. Una semana más tarde, en el foro electrónico de Westminster en Londres, Francisco Mingorance, Oficial Superior de la BSA, Director de Asuntos de Gobierno, hizo el mismo punto (echar un vistazo al artículo de Glyn Moody's sobre el evento aquí [http://blogs.computerworlduk.com/open-enterprise/2010/09/double-standards-on-open-standards/index.htm]).

La semana pasada en la OMPI, durante la 15 €ª reunión del Comité Permanente de Patentes, un evento paralelo se llevó a cabo para informar a los delegados de la OMPI sobre la relación entre las patentes y las normas. Dos figuras en el panel se Benoit Mueller, ex Director de la BSA Política Europea de Software, y Jonathan Zuck de la "Asociación para la Tecnología Competitiva", un grupo que presiona por patentes de software. Ambos sostuvieron que las licencias RAND de las patentes en las normas son compatible con el Software Libre, y que los gobiernos no deben expresar incluso la más leve de las recomendaciones por los estándares abiertos de software.

De ninguna manera nos sorprendio ver exactamente los mismos argumentos se repite en la carta de la BSA a la Comisión Europea, firmado por Francisco Mingorance.

Falsas banderas?

Luego está Florian Mueller, quien es un poco de un caso especial. Que se presenta a si mismo como oponente de las patentes de software en Europa en 2005, para ganarse un poco de credibilidad en la comunidad de software libre. Recientemente, sin embargo, ha estado corriendo alrededor de la web como un "promotor de software independiente", una de sus frases favoritas: "Open Source Software debe ser capaz de hacer frente a las licencias de patentes en caso necesario". Haciéndose eco del mismo mensaje que Microsoft y BSA en su propio blog, y en de comentarios diversos a traves del Internet. Al ser cuestionado admite ser pagado, pero "no voy a decir por quién" [http://blogs.computerworlduk.com/open-enterprise/2010/09/double-standards-on-open-standards/index.htm]

"He hecho algo de trabajo en relación con asuntos de competencia, expresamente exentas en virtud de las normas de transparencia de la Comisión Europea. Usted no está en condiciones de pedir una revelación que no hace la Comisión." [En otras palabras: si la Comision Europea no pide esas revelaciones, usted no puede - En dos palabras "no joda."]

Si bien no tengo ningún problema, en principio, con la gente que cabildea por lo que les quiera - €¡eh, libre expresion -, cabildear sin revelar quién lo respalda o paga me parece amoral. (Puedes encontrar la lista de los que respaldan a la FSFE aquí [http://fsfe.org/donate/thankgnus.en.html].)

En él para el largo plazo

El Marco Europeo de Interoperabilidad [http://www.fsfe.org/projects/os/eifv2.en.html], es sólo una batalla mas entre muchas. Además del tema de la interoperabilidad en el sector público, está la tarea de reformar los sistemas de normalización para que produzcan los estándares abiertos, y educar a los responsables políticos sobre la importancia de la cuestión. Estoy seguro de que vamos a enfrentarnos con la BSA y sus amigos muchas veces durante este esfuerzo a largo plazo. Vamos a tener que seguir luchando contra las cabezas de la Hidra de Lerna durante algún tiempo todavía.

Ciertas palabras como Open Source Software no pueden ser traducidas literariamente al español, pues perderian su significado: "Software Abierto" no tiene sentido. Otro ejemplo, Free Software no significa software (programas, aplicaciones) gratis, sino SOFTWARE LIBRE en el sentido de que es LIBRE como en LIBERTAD DE EXPRESION.

Finalmente esta traduccion aunqe no perfecta para algunos servira de informacion a la juventud de los paises Latino Americanos. La batalla en Europa por estandares abiertos va afectarnos a nosotros asi como a todos los paises del Tercer Mundo. Tenemos que informarnos y concientizar a nuestros compatriotas acerca de esto. No olvidemos como Microsoft y sus socios corrompieron el standardisation process de OOXML en Colombia asi como en el resto del mundo. Tampoco sus continuos esfuerzos pare hacer que Brazil desista en su processo de migracion y apoyo al formato Open Document. Su interes asi como el de las compañias que son parte de la BSA no es la libertad y prosperidad de los pueblos, si no esclavizarlos a sus formatos y supuestos estandares para asegurarse de una continua fuente de ingresos. Como decia Ruben Blades: "se ven las caras, pero nunca los corazones". Solo la oposicion a todo tipo de software patentes y el uso de FREE SOFWARE garantizan la independencia de nuestras naciones. En nuestras manos esta oponernos al COLONIALISMO DIGITAL.
