Fake Charities, Microsoft-Lenovo, and Microsoft-VMware

Posted in Deception, IBM, Microsoft, Novell, SLES/SLED, Virtualisation at 4:42 am by Dr. Roy Schestowitz

“You don’t need to buy the company, just destroy them and then take their business.”

Duncan ‘Dragons Den’ Bannatyne

IMPORTANT OBSERVATIONS THAT ought to be made are grouped under this single post although they are separate (and yet related in terms of their theme). Suggestions are welcome if you believe that there is better way to organise our findings. We are still experimenting with layout and presentation based on readers’ feedback.

“Dr. Evil”

This is not a political rant but a matter of understanding how the system works. We wrote about the Gates Foundation yesterday because there is a lot more to be told regarding ways in which such “charities” operate.

PR Watch is a site that we warmly recommend (as does Richard Stallman) and yesterday it published a couple of articles about a very nasty man whom they say “perfected the art of setting up non-profit “charitable” groups to advance corporate interests.” The guy is so criminal minded that even his own son publicly calls him a “mother****ing son of a b**ch.” Yes, even his own son craves to be dissociated from his father’s evils.

Berman has long been the front man through which corporations have aggressively attacked their opponents without leaving fingerprints. Known to his own friends and enemies alike as “Dr. Evil,” Berman has perfected the art of setting up non-profit “charitable” groups to advance corporate interests.

[...]

David’s powerful note provides insight into the tortured feelings David has endured as the son of the Lobbyist from Hell. We well agree that Rick Berman is guilty of shamefully obstructing public health and working to crush those who care about public welfare, clean air, the environment, animal rights and other causes. For any normal father, this public note would be excruciatingly painful. For all we know, it might be for Rick Berman, too. But will the pain of this note be enough to change him?

We hope David’s public expression of his feelings about his father’s work will make Rick Berman think about what he is doing to society, if not his family. If it isn’t, well then David, we are on your side and are willing to help you in any way we can.

In another new article you’ll find Rick Berman ‘in action’. It’s worth reminding ourselves that Microsoft is the top lobbyist in its area. Regarding Berman and “charities”, these are sometimes known as “pet charities” and we wrote quite extensively about them before. A lot more could be said about pressure groups also [1, 2, 3, 4, 5, 6].

Lenovo Takes the Pill

The Lenovo-Microsoft relationship was mentioned here earlier and perhaps it’s a little surprising because of the IBM roots (IBM is no friend of Microsoft). Lenovo has gone as far as neglecting all GNU/Linux distributions other than the ‘Microsoft-approved’ ones, SLED/SLES [1, 2, 3]. These are distributions from which Microsoft is extracting money. “Patent royalties” is what Microsoft openly calls the SUSE voucher.

Well, it seems like Lenovo will be getting some more of Microsoft inside itself pretty shortly.

Lenovo — the personal computer giant — today announced the purchase of Seattle-based Switchbox Labs for an undisclosed price.

Led by former Windows marketing vice president Michael Sievert, Switchbox was relatively unknown until two weeks ago when my TechFlash colleagues uncovered the startup’s name and corporate documents.

That’s the unfortunate side effect of executives who are leaving Microsoft (or getting fired). They land inside other companies where even greater damage can be caused because of "faith" and inter-personal relationships.

Crime is Not Necessarily a “War”

On many occasions we have already mentioned Paul Maritz and his participation in (white-collar) crime inside Microsoft. For patient eyewitnesses and reserachers, this all exists in material which arrived at the United States courts and there is little room for subjectivity.

A few days ago, VMware had a teleconference and therein an innocent observer will find Maritz calling what he did “software wars against IBM, Novell, Netscape and others…”

He said:

I saw Tod in action during some of the big battles of the ‘90s, the big system software wars against IBM, Novell, Netscape and others and since then, Tod has gained deep operational experience at BEA and Boland.

Those who keep an eye on this site may find it cumulative because we’ll be exposing many more of the illegal activities from Paul Maritz & colleagues. And we’ll never forget what he and Tucci have already done to VMware (2008). It is/was utterly disgraceful, but the mainstream press did not cover it properly, if at all. Those who forget or never get informed are bound to be hurt again.

Vale of memory

I strongly disagree with the worldview that Roy is peddling. Many of Rick Berman’s causes are entirely decent and reasonably causes and it’s sad that Berman’s son is such a leftist loon. For example, one thing that Berman is fight for is secret ballot elections in union organizing. The reason for secret ballots in elections has always to curb corruption and intimidation. I could go through the rest of Berman’s causes and either agree with them or point out why someone else could agree with them–without that person being in it for the money.

Is there is site presenting counter views?

That’s a reasonable question. I’ll look tomorrow and just you a personal email, if I find one. On the other hand, I’m not sure that given Berman’s defence of alcohol, tobacco, and tanning that he’ll get many defenders. There is the heavy hand of political correctness. Even I strongly oppose the tobacco and tanning industries, but I do see that there is a need to make a counter argument–just as in a trial we have a lawyer for the defence. Furthermore, I’m glad that Berman defended alcohol as I like some from time to time. For that matter, I’m happy when people defend marijuana, though I don’t use it. People and our animal brothers and sisters all seem to want a little better living through chemistry now and then.

PR Watch is a site that I read regularly and trust. The other one may be naturally biased, so pluralism of sources would be handy (giving one the right to defend self).

What Else is New

  1. The EPO is Lying to Its Own Staff About ILO and Endless (Over 2 Years) EPO Mistrials

The creative writing skills of some spinners who work for Battistelli would have staff believe that all is fine and dandy at the EPO and ILO is dealing effectively with staff complaints about the EPO (even if several years too late)

  2. EPO’s Georg Weber Continues Horrifying Trend of EPO Promoting Software Patents in Defiance of Directive, EPC, and Common Sense

The EPO's promotion of software patents, even out in the open, is an insult to the notion that the EPO is adhering to or is bound by the rules upon which it maintains its conditional monopoly

  3. Protectionism v Sharing: How the US Supreme Court Decides Patent Cases

As the US Supreme Court (SCOTUS) starts delivering some decisions we take stock of what's to come regarding patents

The disdain and the growing impatience have become a huge liability not just to Battistelli but to the European Patent Office (EPO) as a whole

  6. The Photos the EPO Absolutely Doesn't Want the Public to See: Battistelli is Building a Palace Using Stakeholders' Money

The Office is scrambling to hide evidence of its out-of-control spendings, which will leave the EPO out of money when the backlog is eliminated by many erroneous grants (or rejections)

  7. In the US Patent System, Evolved Tricks for Bypassing Invalidations of Software Patents and Getting Them Granted by the USPTO

The decreasing number of people who cover EPO scandals (partly due to fear, or Battistelli's notorious "reign of terror") and a cause for hope, as well as a call for help

  9. As Expected, the Patent Microcosm is Already Interfering, Lobbying and Influencing Supreme Court Justices

The US Supreme Court (SCOTUS) is preparing to deliver some important decisions on cases with broad ramifications, e.g. for patent scope, and those who make money from patent feuds are attempting to alter the outcome (which would likely restrict patent scope even further, based on these Justices' track record)

  10. Intellectual Ventures -- Like Microsoft (Which It Came From) -- Spreads Patents to Manifest a Lot of Lawsuits

That worrisome strategy which is passage of patents to active (legally-aggressive) trolls seems to be a commonality, seen across both Microsoft and its biggest ally among trolls, which Microsoft and Bill Gates helped create and still fund

  11. What the Patent Microcosm is Saying About the EPO and the UPC

Growing concern about patent quality at the EPO -- a subject which causes managers to get rather nervous -- is now an issue at the forefront

  16. EPO Reduces the World to Just Seven Nations to Bolster an Illusion of Growing 'Demand' for European Patents

The unscientific -- if not antiscientific -- attitude of the European Patent Office (EPO) continues to show with the arrival of yet more misleading 'infographics' (disinfographics would be a more suitable term)

  17. Letter to Angela Merkel Expresses Concerns About Impact of EPO Scandals on Germany and Its Image

A new cartoon about the legacy of Battistelli, which ruins both inventors and staff (examination) while handing money to abusers

  19. Are Lithuania and Latvia the Latest Additions to the List of Benoît Battistelli's Vassal States?

Benoît Battistelli's 'back room' deals came at an interesting, strategic time and the Office uncharacteristically kept quiet about these

  22. Insulting Reversal of Narratives at the EPO: Team Battistelli as the Victim

At times of great oppression against staff, in clear defiance of the law in fact, journalists are being asked (or expected) to view the oppressor as the victim, even when this oppressor drives people to suicide

  23. Battistelli's EPO Copies China -- Not the US -- When it Comes to Patenting Software and Expanding Patent Scope

A detailed explanation of some of the latest reports from China and the US, serving to show that one opens up to software patents whereas the other shuts the door on them (and guess whose lead the EPO is taking)

  24. What IAM Says About AST, RPX, Ericsson, and IBM

IAM, the trolls' mouthpiece (also the EPO's mouthpiece, but that's another story), provides updates on trolls and troll-like entities, but further commentary is needed to clarify and counterbalance the promotional language

The longstanding concern about the granting of software patents at the EPO (typically disguised as a "device") as reinforced by T 0625/11

  28. Links 19/3/2017: Linux Sightings, What's Wrong With Microsoft, and Death of Docker

    Links for the day

  29. Governance Crisis at EPO Deepens After Latest Meeting of the Administrative Council, Necessitating Urgent Outside Intervention

he EPO's Administrative Council continues to be subservient to -- and without any authority over -- Team Battistelli with its endless mischief and endless power grab, including unbridled money grab

  30. EPO Management Deeply Concerned That the Public Has Found Out Quality of European Patents (EPs) Nosedived Under Battistelli's Regime

Growing pressure on the EPO's management to acknowledge that quality control has gone totally out of control as stakeholders already grasp the obvious and act accordingly, turning to other patent offices, such as their national ones (NPOs)
