… it is only good to be a massive corporation such as IBM, a patent troll, or a patent lawyer. Finjan, which has become a bit like a patent troll, isn’t doing too badly.
If examiners are led to believe that more patents mean more “success”, then they probably need to reassess their views. More patents typically mean lower barrier to acceptance or, in other words, lower quality of patents. █

… Does US law dominate globally? Well, rhetorical question actually. This is similar to the cases of Finjan, which is a patent aggressor in a similar field of technology.
As a British programmer myself, I cannot help but worry that the Texan courts now threaten the British industry as well. The UPC would make things even worse and there are already signs of that happening with patent trolls that come to Europe and attack from London (Unwired Planet). Apple too is attacking companies from …

… joined by other trolls, famous lawyers of trolls, and Microsoft-connected aggressors like Finjan. There’s no FTI Consulting in sight, so the EPO connection (not the IAM connection) seems likely to have put them in the UPC event. Among other sponsors we only see the world’s most vocal proponents of software patents, which serves to reinforce our perception of the principal forces behind UPC.
Isn’t that wonderful? Shameless lobbying with the veneer of an ‘independent’ …

… (cherry-picking) about Alice when it’s some Microsoft-connected patent aggressor like Finjan managing to convince a court to uphold a software patent, as we recently noted. This new article by Monte Cooper and Cam Phan from Orrick says: “This goes to show that despite the significant shift that has occurred since the Alice decision, all hope is not lost for plaintiffs asserting patents in the software space.”
“There is a war going on in the software domain and it is …

… not an isolated example. In another lawyers’ site, the Microsoft-connected patent aggressor Finjan is mentioned by Orrick, Herrington & Sutcliffe LLP. These US-based patent lawyers only ever speak out about Alice when they can defend software patents. It’s cherry-picking of data or selective coverage, much like the data which global warming denialists prefer to rely on. This new article says that “[t]his goes to show that despite the significant shift that has occurred …

… or fairly compete against it
M ICROSOFT not only invests in patent aggressors (e.g. Finjan) but is also feeding some patent trolls with patents (e.g. MOSAID, a.k.a. “Conversant” following a rename), creating new patent trolls (like the world’s biggest, Intellectual Ventures ), and turning real companies into trolls (case of point being Nokia, which we wrote about yesterday in light of royalty stacking against Android ).
We cannot emphasise this strongly enough: …

… — continue to weigh down companies that innovate
S everal years ago we wrote about Finjan [ 1, 2, 3, 4, 5, 6, 7 ], noting the Microsoft connection and the effect on software patents policy in Europe. It is now being reported that Finjan is on the offence again. “Complaint alleges infringement of Finjan patents relating to endpoint, Web, and network security technologies,” says the summary. This is of course about software patents and it harms producing …

… trick up its sleeve: It lies to investigators about where the money is going.
First uncovered by Finjan Software last week, the URLzone Trojan is already known to be very advanced. It rewrites bank pages so that the victims don’t know that their accounts have been emptied, and it also has a sophisticated command-and-control interface that lets the bad guys pre-set what percentage of the account balance they want to clear out.
The article leaves out an important bit of information which …
