Para aquellos que han estado viviéndo bajo una roca desde el 2006 (el acuerdo de patentes con Novell), Microsoft está tratando de imponer impuestos sobre GNU/Linux, increméntando sus costos mientras al mismo tiempo convirtiéndolo en una vaca de dinero para Microsoft (de la misma manera que lo hace con Android actualmente), mediante el el uso de patentes de software. Microsoft SIEMPRE COERCE a las partes chantajadas a decir (públicamente) que todo es amigable mientras los arreglos esta envueltos en una saband de NDAs (Acuerdos de No Disclosure). Para añadir insulto a la herida, Microsoft esta ESTAFÁNDO a GNU/Linux (Canonical en este ejemplo) y luego PATENTANDO LAS IDEAS DE CANONICAL/UBUNTU. Veán este nuevo artículo de un sitio propagandista de Microsoft. Es títulado “Microsoft aplica por patente Continuum” y los comentarios al respecto dicen (entre otras cosas): “El asunto que los medios principales piensan que esto es una idea de Microsoft, e incluso llama al Ubuntu convergencia siendo inspirada por continuum. !Qué tal concha!

Citando comentarios del artículo mismo tenemos: “Me pregunto como esta patente se compara con Convergencia de Ubuntu que ellos han estado DESARROLLANDO POR AÑOS? Esencialmente parece ser lo mismo ya que los teléfonos de Ubuntu se conectan a un monitor y actúan como un órdenador completo.”
Otra persona escribió: ¨No estoy seguro que MS lo consiga. El argumento de Arte Previo. Ubunto ha estado trabajando en la misma cosa los últimos años. Lo llaman ¨Convergencia¨, ha estado a prueba por el último año o más… sin mencionar su previo projecto de incluir ambos Android y Ubunto en el mismo aparato, con los mismos propósitos.¨

Así que en sólo dos dias aparte Microsoft firmó dos ¨arreglos¨ de patentes relacionados con Linux (EXTORSIÓN), pero los medios únicamente se enfocan en las relaciónes públicas PR de Microsoft (¿cuánto dinero hay por debajo de la mesa?). Aquí hay una suerte de publicación que casi nadie se dió cuente, excepto este artículo tardío (esta mañana) que dice ¨Microsoft acaba de anunciar que firmó un nuevo acuerdo de patentes sobre sus patentes sobre Linux y Android, esta vez con la compañía Japonesa Rakuten.¨

Esto es un artículo superficial por un escritor ocasional y otro nuevo artículo de su colega (ayayero de MS) Sam Varghese, los cuales mencionan casi nada de los ATAQUES DE MICROSOFT CONTRA GNU/LINUX. Planet Debian también se obsesiona sobre las noticias erróneas (como los apoyadores de Debian), lo cual no so nueva noticias de ninguna manera. La cosa Microsoft/SONiC/Debian no son nuevas noticias porque fuen mencionado en los pasados meses. Son viejas recicladas o re-anunciadas por Microsoft parte de su propaganda, que sólo sirven para distraer (dos ataques en una semana), sea por diseño o coincidencia, lo dudamos.
Allá en Fuerza FOSS Christine dijo que ¨todos estos esfuerzos tienen como objetivo canalizar negocios a la manera de Microsoft. Es una calle de un sólo sentido. Redmon únicamente esta haciendo fácil para desarrolladores de open source trabajen y jueguen bien con el universo de Microsoft.¨
Otro periodista dijo que la ¨cosa grande hoy es SDN -o software definiendo redes – y Microsoft hizo que Linux lo haga posible.¨ ¿Mientras al mismo tiempo esta imponiendo impuestos sobre Linux con patentes? En las cortes Microsoft insiste que Linux es us ¨propiedad intelectual.¨ Ahora esno no es simplemente actuar como si Linux fuese de su propiedad. ¿Cuán conveniente es que la gente olvide (no preste atención) que MICROSOFT TODAVÍA ESTA ATACANDO lINUX CON PATENTES DE SOFTWARE. Talvez no estén prestando atención pero eso seguramente no ayuda. Microsoft no puede amar a Linux ni siquiera aprender a amarlo. Únicamente puede pretender hacerlo cuando le convenga con sus propósitos de mercadeo o su estrategia de E.E.E (Abraza, Extiede, y Extingue).

Los ayayeros de Microsoft de seguro cubrieron lo malo y en general en los sitios de noticias generales el titular fué cambiado a ¨Microsoft lanzará un personalizado Debian Linux. Repetimos, un personalizado Debian Linux para redes¨ a ¨Microsoft ha lanzado un cambia Debian Linux OS. Repitiendo un Debian Linux cambiate sistema operativo¨ (lo que es enteramente una cosa diferente, sugiriendo que es simplente noticias recicladas). The Register ha reescrito su engañoso titular acerca de Microsoft y Debian y súbitamente parecen como noticias del año pasado.
¿Porqué no hay un reportaje investigativo acerca de los ataques de Microsoft contra Linux? Los apologistas de Microsoft les siguieron el cuento (como siempre) tomando estas noticias del año pasado diciendo: ¨Posen sus tazas de cafe suavemente, Microsoft lanzará hoy un personalizado sistema operativo basado en no otro que Debian GNU/Linux, for network switches,¨ La idea probablemente fue ¨prestada¨ de Brocade Vyatta 5400 router which is also based on Debian GNU/Linux. Lo que demuestra como a lo largo de su historia Microsoft se ha apropiado del trabajo de otros.
¡No!, no hoy, no ayer. Esto son viejas noticias. Y se estan perdiéndo las verdaderas. █

Horas más tarde descubrimos que el odio de Microsfot contra Linux todavía los hace enorgullecerse. Como este nuevo artículo de Bogdam Popa lo puso, la extorsión de patentes de Microsoft contra Linux le otorgará ¨$3 Billones cada año sin mover un dedo,¨ o para citar su sumario completo: ¨Microsoft ha anunciado que alcazó un acuerdo do con Wistron para renovar su arreglo de patentes que cubren a Android, asi que la compañía puede seguir usando la tecnología de Redmon en sus tabletas, smartphones, e-readers y otros aparatos que usen Android o Chrome OS.¨

How many people even noticed (let alone wrote about) Microsoft’s Wistron and Rakuten patent settlements that explicitly cover Linux?
Sending journalists in many different directions to distract from the really outrageous news
Summary: Microsoft loves Linux enough to strangle it to death with patents while the media isn’t paying attention and instead telling us that Microsoft is now a buddy or “pal” of GNU/Linux
MICROSOFT HAS — whether deliberately or not — been distracting the media and disguising several patent attacks on Linux by openwashing its latest proprietary crusades (bringing Microsoft’s proprietary software and lock-in to FOSS and/or GNU/Linux). For those who have been living under a rock/tree since 2006 (the Novell-Microsoft patent deal), Microsoft is trying to tax GNU/Linux, raising its cost while also making it a cash cow of Microsoft, by leveraging software patents. Microsoft always coerces the extorted party into stating (in the public eye) that everything is amicable while the settlements are wrapped in a coat of NDAs. We gave an example of this last month (Acer). It’s not only unjust; as per the RICO Act, this should come under investigation for potential violations of the law. This, in our view, is racketeering. “That’s extortion,” Mark Shuttleworth (founder of Canonical) said many years ago, “and we should call it what it is. To say, as Ballmer did, that there is undisclosed balance sheet liability, that’s just extortion and we should refuse to get drawn into that game.” On another occasion he told the media: “Microsoft is asking people to pay them for patents, but they won’t say which ones. If a guy walks into a shop and says: “It’s an unsafe neighbourhood, why don’t you pay me 20 bucks and I’ll make sure you’re okay,” that’s illegal. It’s racketeering.”
To add insult to injury, Microsoft is ripping GNU/Linux off (Canonical in this one example) and then patenting the ideas of Canonical/Ubuntu. See this new article from a Microsoft propaganda site. It’s titled “Microsoft applies for Continuum patent” and comments on it say (among other things): “The issue is that mainstream media think it is MS idea, even calling Ubuntu convergence being inspired by continuum.
“To add insult to injury, Microsoft is ripping GNU/Linux off (Canonical in this one example) and then patenting the ideas of Canonical/Ubuntu.”“Canonical took to long to deliver (and still actually didn’t) on the convergence idea, now it’s too late and Ubuntu phone will soon die.”
Quoting comments from the article itself we have: “I wonder how this patent compares to Ubuntu’s convergence that they’ve been working on for years? It seems essentially the same in that they expect Ubuntu Phones to attach to a monitor and act as a full computer.”
Another person wrote: “Not sure that MS can get this. Prior-Art argument. Ubuntu has been working on the same thing for the last few years. They call it “Convergence”, it’s been in testing for at least a year or more…. not to mention the previous project to run Android and Ubuntu on a single device with the same purpose.”
“Despite being anything but an innovator, Microsoft is extorting companies behind the scenes using these bogus patents.”“It’s not worth doing,” another person wrote. “Continuum has been done with Convergence with Ubuntu, and I think KDE Plasma Mobile is working on something similar too. Microsoft is just attempting to gain a patent for something that they can then sue everyone away from doing. In other words, Microsofting the competition.”
Among the other comments we have “Prior art is all over the place” and “This is a complete bullshit patent.”
Despite being anything but an innovator, Microsoft is extorting companies behind the scenes using these bogus patents. Days ago we wrote about Wistron, whose patent ‘deal’ (surrender) with Microsoft is now covered in a variety of other sites, e.g. [1, 2, 3]. A lot of sites did not cover this because they were too busy writing puff pieces about Microsoft ‘embracing’ FOSS or Linux (Microsoft embraced neither, except in the E.E.E. sense). “The deal,” WIPR said, “announced on Monday, March 7, covers Wistron’s tablets, mobile phones, e-readers and other devices running the Android and Chrome platforms that fall under Microsoft’s patent portfolio.”

I had a bit of a chat with him about this [1, 2, 3, 4, 5]. He’s clearly too smart to fall for Microsoft’s charm offensive. Microsoft loves Linux? Well, just ignore “Microsoft Technology Licensing LLC,” which is attacking Linux, essentially engaging in blackmail and extortion with software patents. Also take note of this report from yesterday (“EU Taking Steps Towards Formal Complaint Against Google’s Android” over at Bloomberg) which reminds us that Microsoft is still lobbying and AstroTurfing (lobbying by proxy) against Linux, as we explained many times before.
So, this is the real Microsoft and for those who think it “loves Linux” perhaps a bit of a broader perspective may be necessary. The media sure isn’t helping because all it has done this past week is reposts/recycling of marketing images from Microsoft (with red-coloured hearts in them). That’s hardly journalism; it’s often called churnalism as it requires no research or input, just a little editing.

Again and again. It happened a second time this week alone, while the media wasn’t paying attention. Only Microsoft propaganda sites [1, 2] have covered it (so far, with the expected bias) and the Microsoft boosters try to make this racketeering look like “pals”. Why are general news sites or GNU/Linux sites not paying attention? It was simply nowhere in the news, not ‘on the radar’. Microsoft is now acting exactly like a patent troll, and it’s called “Microsoft Technology Licensing LLC,” based on the announcement which says: “Microsoft Technology Licensing LLC and Rakuten Inc. on March 9 signed a worldwide patent cross-licensing agreement covering each company’s respective consumer electronics products, including Linux and Android-based devices.”
So only 2 days apart Microsoft signed two Linux-related patent ‘deals’ (extortion), but the media focused only on Microsoft PR. Here is a sort of press release that almost nobody noticed, except perhaps this belated article (this morning) which says “Microsoft has just announced that it signed a new deal over its Android and Linux patents, this time with Japanese company Rakuten.”

Why is this not being covered? IT Wire portrays Microsoft as a friend of Linux. This is far too shallow an article by an occasional writer and another new article from his colleague, Sam Varghese, mentions almost nothing at all about Microsoft’s attacks on GNU/Linux. Planet Debian also obsesses over the wrong news (so do Debian supporters), which isn’t even news at all. The Microsoft/SONiC/Debian thing is not news because it was mentioned in passing several months ago. It’s old new recycled or re-announced by Microsoft for propaganda, serving to distract from patent extortion (two incidents thereof), whether by design or by pure coincidence, which we doubt.
Over at FOSS Force, Christine says that “[a]ll of these efforts are entirely aimed at channeling business Microsoft’s way. It’s a one-way street. Redmond is only making it easy for open source developers to work and play well with the Microsoft universe.”
One journalist said that the “big thing today is SDN – or software defined networking – and Microsoft turned to Linux to enable it.” While also taxing Linux with patents? In the courts, Microsoft insists that Linux is its “intellectual property”. Now it’s just acting as though Linux is its property. How conveniently some people forget that Microsoft is still attacking Linux with software patents. Maybe they’re just not paying attention and the media surely isn’t helping. Microsoft cannot love Linux or even learn to love it. It can only pretend when it suits the goals of the marketing or E.E.E. strategy.

Repeat, a custom Debian Linux for networking” to “Microsoft has released a Debian Linux switch OS. Repeat, a Debian Linux switch operating system” (which is an entirely different thing, suggesting that it’s just recycled old news). The Register had rewritten its initial misleading headline about Microsoft and Debian and suddenly it looked like news from last year.
Why is there no investigative reporting about Microsoft’s patent attacks on Linux? Microsoft apologists played along by taking this news from last year and saying: “Put down your coffee gently. Microsoft will today release a homegrown open-source operating system, based on none other than Debian GNU/Linux, for network switches.”
Nope, not today, not yesterday. This is old news. And they’re missing the real news. █

Summary: Microsoft is still killing (free) Linux with software patents whilst at the same time telling the media that it “loves Linux”
THIS morning we wrote about Microsoft layoffs and an effort to engulf GNU/Linux with proprietary Microsoft software. The PR/charm offensive from last night hasn’t even had much time to cool down and here is another puff piece from the Microsoft-occupied BBC (many Microsoft UK executives became managers there). As this new article by Bogdan Popa put it, Microsoft’s patent extortion of Linux is to net “$3 billion every years without moving a single finger,” or, to quote the summary in full: “Microsoft has just announced that it reached an agreement with Wistron to renew their Android patent licensing agreement, so the company can continue using Redmond’s technology on its tablets, smartphones, e-readers and other devices powered by Android or Chrome OS.”

Summary: The misguided and direction-less company from Redmond is hoping that enough people out there are foolish enough to believe that Microsoft “loves Linux” and will therefore help Microsoft abduct GNU/Linux by putting insecure proprietary software in it
Microsoft layoffs have been accelerating even though the company does a decent job hiding it (our sources inside Microsoft are surprised that the company is unable to keep it secret).
Based on this report, having already shut down some of its gaming studios (firing all the staff) and now that it’s alienating outside studios [1-4], the company is preparing to toss Lionhead Studios in the trash. One of its developers, who had worked there even before the Microsoft takeover, used to be a regular in our IRC channels. To quote one of the reports about it: “The game publisher and hardware maker announced today that it is canceling Fable Legends, the next installment in the fantasy series that has been an Xbox staple since its debut in 2004. Microsoft also said that it has proposed completely closing Fable developer Lionhead Studios. This could mark the end of one of the most iconic developers in the $99.3 billion global game industry (based on market researcher Newzoo’s estimates).”
“Microsoft is basically a dying company.”Suffice to say, Microsoft is not doing well. Vista 10 has been such a disaster that the company now forces people to install it and turns the screensaver/lockscreen into ad space (we didn’t find time to cover this because of the EPO emergency). Moreover, as last night’s news serves to show, Microsoft is trying to stay relevant by putting its tentacles on GNU/Linux. We already put two dozen SQL Server links in our last night’s daily links (and in Tux Machines under the title “Microsoft Proprietary Software Spreads”). This has been covered by GNU/Linux proponents [1, 2, 3, 4], Microsoft boosters, and of course some news sites that carry water for Microsoft, promotional banners with the heart symbol included [1, 2]. They don’t try to understand for themselves what’s going on here and instead do an ‘easy’ job by just parroting Microsoft.
Microsoft is basically a dying company. Buying back one’s shares only gives the illusion that it’s business as usual. Windows as a franchise is dying. Don’t let it turn GNU/Linux into a proprietary software platform with NSA back doors (remember it was Microsoft that kick-started PRISM with the NSA). █

In my view, this is the most aggressive move Microsoft has ever made. While the company has been convicted of violating antitrust law in the past, its wrongful actions were limited to fights with specific competitors and contracts with certain PC manufacturers.

In a scathing editorial in The Guardian, Epic Games cofounder Tim Sweeney spoke out about Microsoft’s Universal Windows Platform (UWP) initiative, calling it a “fiasco” and “the most aggressive move Microsoft has ever made.”
“With its new Universal Windows Platform (UWP) initiative, Microsoft has built a closed platform-within-a-platform into Windows 10, as the first apparent step towards locking down the consumer PC ecosystem,” said Sweeney. “Microsoft has launched new PC Windows features exclusively in UWP and is effectively telling developers you can use these Windows features only if you submit to the control of our locked-down UWP ecosystem.”

GAMING VETERAN Tim Sweeney, co-founder of Epic Games, which gave the world the Unreal Engine and games like Gears of War, is worried that Microsoft will ruin the games industry if the firm is allowed to continue its closed platform proposition.
Sweeney was given room to write about this in The Guardian (Tim, if you’re reading this you can come to us first next time) and made the most of the noises from Microsoft about bringing console and PC gaming closer together.
“With its new Universal Windows Platform initiative, Microsoft has built a closed platform within a platform in Windows 10 as the first apparent step towards locking down the consumer PC ecosystem and monopolising app distribution and commerce,” he wrote.

IS the SCO saga “over”? That’s what they told us half a decade ago, yet today’s (and yesterday’s) headlines [1-4] suggest this is definitely it, no matter what happens next. Novell was actually “over” a long time before SCO was truly “over” (“don’t make me over,” it perpetually insists and shouts at the judges, like Dianne Warwick while throwing her now-famous fit at Burt Bacharach and Hal David), unless one counts the “Novell” brand which was carried forward, or abandoned efforts/teams such as Mono/Ximian, which based on this news from Phoronix is already being used for E.E.E. (this time involving Vulkan), shortly after Microsoft tied the knot. Don’t ever forget Microsoft’s true colours. The company hates GNU/Linux with a great passion; it just tries to hide it while working to undermine GNU/Linux. █

The case was opened in 2003, when SCO filed a $1B claim against IBM. The suit alleged that IBM had inserted some code from Unix, over which SCO claimed ownership, into the Linux kernel.

A new filing (PDF) scooped up by the good folks at Groklaw sees both SCO and IBM agree to sign off on two recent decisions in which SCO’s arguments advancing its claims to own parts of Unix were slapped down by the US District Court.
As The Register reads the PDF we’ve linked to above, and our informal legal counsel concurs, the new document describes IBM and SCO both signing off on the recent court orders. Those orders left SCO without a legal argument to stand on.
The new filing also points out that SCO remains bankrupt and has “has de minimis financial resources beyond the value of the claims on which the Court has granted summary judgment for IBM.”
Or in plain English, SCO is broke and the only asset it possess of any value is its claims against IBM, and now it doesn’t even have those because it just lost a court case about them. That leaves SCO in no position to carry on.
“Accordingly,” the new filing continues, “the disposition of SCO’s appeal is the practical course most likely to conserve both judicial and private resources.” That’s the legal sense of “disposition”, by the way, so what the document’s saying is that SCO giving up its appeal is most likely to stop the courts spending any more time or energy on this matter. Courts don’t like wasting resources. So this is both parties explaining that wrapping things up now is a desirable thing.

Hold onto your hats.” Richard Freeman reminded folks the systemd disagreements aren’t over either and Debian has finally stopped renaming Firefox to Iceweasel. Dedoimedo said today that Mepis derivative MX-15 is on the “highway to rad” and Christine Hall signed SCO’s death warrant.

It appears as if SCO’s case against IBM, which began as a blustering tornado back in 2003, finally died with a whimper last week. The death notice came in the form of what is essentially a one page agreement between SCO and IBM which calls “for certification of the entry of final judgment on the Court’s orders concerning all of SCO’s claims….”

THE TROJAN horse strategy of Microsoft can only ever work as long as FOSS developers are naive enough to believe that Microsoft comes with good intentions. We have already seen openwashing of Microsoft lock-in like .NET (there is more of it today from Pierre-Luc Maheu), even though it’s still proprietary lock-in with some open ‘core’. We wrote a lot about this in 2014.
Just as Microsoft uses Cyanogen as a Trojan horse in mobile (Android), Microsoft has used Xamarin as a Trojan horse for a number of years now (not just in mobile).

RoboVM was part of an embrace phase (in E.E.E.); it’s almost as though Microsoft bought a Java/Android company, which it soon took proprietary (extend) and can now use as a Trojan horse for .NET conversions (extinguish) because RoboVM employees all become Microsoft employees, within just a few months. It’s like Nokia all over again and it happened in a nearby country (neighbour of Finland).
Proving Techrights was right all along, earlier today was found this post from Phoronix which said “Xamarin was formed by Miguel de Icaza in 2011 after his earlier Mono-focused company, Ximian, was acquired by Novell but then the Mono developers were let go when Novell was acquired by Attachmate.”

Like Microsoft is bad but Xamarin is okay. You know what’s the most ironic thing? Miguel said that GNU/Linux won’t ever be popular because of compatibility issues after he moved to OS X. The most compatibility messing thing in GNU/Linux is GNOME’s GTK+.”

Leading? How many people even use this thing? Xamarin, in recent years, hired longtime enemies of this site (Techrights) — people who publicly attack me all the time for ‘daring’ not to trust Microsoft and Mono. They even hired Jo Shields, who has been cursing and swearing, sometimes even libeling me. These are Mono boosters who are more like moles inside GNU/Linux. Well, from now on they’ll get their salary directly from Microsoft and any time I see them attacking me online I’d be able to attribute these attacks to Microsoft. I criticise Mono, so they criticise me personally (ad hominem). What a relief it is to know that Microsoft will now bear responsibility for these utterly rude people. The Mono lynch mob is something Microsoft will now be accountable for. █

Como Microsof t anuncia sus tratados de patentes actualmente (cubriendo Android y Linux), usando ambiguedad y eufemismos (¨Acuerdos¨ realmente son secretos asentamientos de patentes)
Sumario: Acer es el último gran OEM que se ha convertido en la caza de brujas por parte de Microsoft contra preinstalladores de Android/Linux, a quienes esta coerciendo en convertirse en transportistas de Microsoft (o enfrentarse a litigaciones sobre patentes de software, con altos costos legales sino bloqueos con altísimos costos por arreglos secretos).
Este artílo cubre una materia sobre la que he estado escribiendo por lo menos una década, frecuentemente de manera dedicada (especialmente el ´arreglo´ de Novell con Microsoft, que puso en riesgo a todo GNU/Linux).

Microsoft no hace software ultimamente, sólo hace MALWARE/SPYWARE como Vista 10 (el SUEÑO DE LA NSA HECHO REALIDAD constantemente esta grabando lo que escribes) o Skype (siempre grabandote), con su inabilidad de salirse de los ´updates´ secretos [1] e incluso bloquear la vigilancia masiva en sus ordenadores [2], basado en nuevos artículos (vean abajo).

Todos sabemos que Windows 10 espía a los usuarios. Lo hemos reportado incluso cuando ellos publicaron us Prevision Técnica de Windows 10 en Agosto de 2014. Después de un año que la versión final Windows 10 fue entregada al público, Microsoft confirmó que Windows 10 espíaba a los usuarios en Noviembre de 2015. Añadió en ese momento que no pudo evitar su telemétrico programa para espíar a sus usuarios.
